    No problem, you can keep an eye on your balances etc using the online service and you can email CCCS direct for advice, they usually reply within 24 hours during the week.

    Like you my plan was going great for 10 months and now everyone seems to be playing up ;) I suppose they are bored of accepting low repayments. Most have accepted again though.

    Thanks, its so annoying it had all gone so quiet I almost forgot we are £48k in debt! oh well, have to face facts again I guess!!!

  • I agree, it was lovely to have a life back for the past 10 months, one that didn't involve debt constantly going through your head. I suppose we just have to expect these little set backs and whenever we feel down or need help, this is the place to come.
    There must have been thousands like us and no doubt there will be thousands more about to hit the same situation.

    It is always wise to request copies of the original agreement from all of your creditors. This enables you to check and see which ones are more likely to be enforceable in court.

    Some people prefer not to ask as they believe that it may annoy a creditor and make them less likely to accept your DMP. But if they are already playing up then it is a good idea. You are legally entitled to request this information at any time, so long as the statutory £1 fee is sent.

    You can request a CCA from your credit card, store cards and loans. However, overdrafts are not included in sections 77-78 CCA1974.

    They dont need your signature to accept any repayment plan, it is merely a smokescreen. If you did sign a new agreement, then they would use it to recover the full amount of the debt.

    If they dont have a valid credit agreement, then how can they add lawful interest to the account??????;) This is the best bargaining tool you can use in future.

    Let them sell to a DCA, it is the better option. Most DCA's will accept your DMP payment, especially if they know they are aware that the account would be unenforceable in court.

    Have you sent a CCA request yet? If not, then I think now would be the best time to do so.

    That is great advice, although I have to say Next have been really cool with my DMP, so it seems a bit mean of me!! A few months ago, there was an item on one of the news channels where a lady was complaining that she couldn't simply order an item from the Next catalogue online without opening a 'credit' account. When she got the invoice for the clothes she bought, she found she had a credit limit of £2,000!! Perhaps doing that has come back to bite Next?

    Icecube, I think I'm right in saying that that the local county councils have a fair bit of clout when it comes to running nurseries, especially when it comes to Health and Safety. Surely tired, overworked staff have a far greater impact than, say, giving kids fish fingers with additives in? I don't want to sound flippant at all, (quite the opposite!) but county councils in England, Scotland, Wales and NI have a lot to answer for, considering they hand out the licences for these places to exist in the first place.

    It maddens me to think of the money churned in by the owners of these nurseries ( and care homes! ) who treat vulnerable young and old people like commodities to make as much money as they can. Without caring, hard working people like you, they would have NOTHING.

    i have seen doctor re the depression and she feels it is more to do with my dad dying, i think its just a combination of everything, I want to go self employed (childminder) but not sure how the CCCS would take this? and also cant do that until my health problems are sorted out, have a scan in a few weeks & may need a hysterectomy, so no good going self employed then needing 6 weeks off (although I dont get sick pay at work so its still a worry). Work treat me badly, I work for a nursery , I often work ten hour shift (8-6) with no break till late afternoon then it's just ten minutes, yesterday I had 8 under 2's on my own, when it should only be 3 under 2's to each adult! its physically & mentally draining!

    Sorry to hear you are struggling - some days are very dark, but hang on in, we are all here to support each other in the down times.
    You will work through this but do look after yourself and give yourself some nurturing.
    I had a heart attack at a relatively young age a few years ago. Believe me NO amount of money is worth risking your health for!
    Hope things inprove for you soon.

    I work for the NHS and it makes my blood boil to see hard-nosed business people milking the 'cash cow' of elderly, often demented folk and treating the staff like minions.
    Like to see some of them spend the day doing what good. caring people do by choice (and for very little financial reward)

    Just waiting for him what dumped me to come round for the evening. Not together again but just like spending time with each other still.

    Yes, I left the NHS to work for the MOD. Really saddened the other day when I heard our new Boss talk about "Customers". Try telling a lad who has his leg blown off in Service that he is a Customer...
