I am sat here crying, i am in debt up to my eyeballs and am trying my best, today CL finance have issued a Warrant of Execution to take goods, total to pay £200ish and o/s £7,000 ish. What do i do, i think its for EGG CC.

Can someone advise me what to do, i cant afford the £200 ish in one go. what do i do. I tried to call the number on the letter.

I have looked at the reasons behind a WoE and it says you have to have defaulted on an agreed amount or missed 2 payments. I havent had an agreed repayment amount from what i can remember.

I know someone on here will advise, i am desperate. The furniture isnt mine its my ex partners, but i cant prove it.

Sorry if i sound desperate but i am..

Is this your only debt or are there more? If so, are you already doing a debt management plan? If not, you may need to consider this.
For now, the pressing issue is the letter you have received. I am assuming they are proposing sending bailiffs round to your house - in that case there are certain things you can do. I am no expert, but I am sure someone else will be along to advise. The general advice is to make sure they can't get into your house and to make sure your car if you have one is parked somewhere else and not outside the property. And you say this company have issued a warrant of execution? I thought only a court could do that. Anyone out there with more knowledge of this sort of thing?

Thought I would mark my place on here. I just got our initial letter from CCCS re our DMP. Guess its our first step on the road to debt freedom, but it does seem so far off.

Im sure Ill be back on here lots in the coming months, at least there is somewhere to go where you can talk to people who understand it all.

p.s. any tips gratefully received :)

    hi
i am max's OH and today I answered my first telephone call with Argos Storecard. I must say i was very nervous about actually explaining the financial difficulties to a random on the phone, she was actually very nice  dont know why? and i explained about being on our DMP and sending out token payments ect, I also requested that I was very depressed about getting phone calls and asked them to put future correspondance in writing, she told me she would put a stop for 30 days on further people calling me and the next call would be from their financial difficulties team to call me to see if they can assist. i have to say that i feel slightly better and a i may be a little bit braver standing my ground when future calls do come through. :T

a good tip, have your dmp ref number and tele number beside phone with copy of letter explaining why you are on dmp as it is a good prompt and makes you sound more in control:j i feel a bit anxious still but i think this a better felling than the feeling i would get if i lost my home or family life! thanks for listening

    Full and Final Settlements

We have been on a DMP for the last seven years. We still owe £24,000 - we have have come into some money and have about £12,000. Does anyone think it would be worth offering full and final settlements at this level - about 50% of the debt. I have seen some people discussing this in the past and would be interested in opinions.
  • Hi Tass, Lucky you!! We can't wait for the day when we will be in the position to offer F&F's!!! I would be really interested too to hear from anyone who has done this. After all the really upsetting things happening to some of us on here, it might give us all a well earned lift.

Hey, Twitty, wee woman!! The sprouts were al dente so putting them on in Feb this year! My 'wads" of cash were dollar bills cos I thought sterling would be too depressing, ha ha. Maybe the Queen doesn't carry cash cos she's on a DMP as well, you never know(!). Glad to hear you are well.

It's gotta be worth a try, just make sure you explain that if you were to do it then that'll be to close off the account - to be settled. Try here for more help.

  • Hi there, well Barclays have started calling me again!

Please could someone send me a link to the template letter for getting them to stop calling me.

This is really starting to bring me down and it was all going so well! (In a nutshell, for those who don't know, they keep saying they haven't heard from Payplan).

    Many thanks, CC

I'm looking for a few template letters also. I thought there was a sticky thread at the top of the Debt Free Wannabe section of the forum, but I can't seem to find it, even with a search. I've probably tripped right over it, but if anyone can post a link to the thread that had all the template letters, it would be most appreciated. Thanks!

Third month of self-administered DMP. First 2 months (Nov/Dec) were £1 token payments with letter to creditors. They've all taken the payments (then asked for more :rotfl:), and all are still charging interest and fees. But we persevere. I will continue to ask that they stop interest and charges with each letter. This month, we had a small amount of money put aside from our monthly budget for debt repayment, which we carefully divided up between the creditors by percentage of debt level and set up standing orders for the credit cards. I need to get the info for the loans so that I can set up standing orders for them as well. They are all getting a letter this month to indicate they are getting slightly more than the token payments now, due to some changes in our budget to free up some money to repay debts, and I am going to be keeping in touch with them every couple months to let them know if things will continue at this level or if we can raise the payment as we go along. I am anticipating a bit more money free to put towards debts each month starting this summer, as DS2 should be potty trained by then and DS3 will be off of formula by end of summer, so those expenses will be no more, thankfully. Small hope that, by keeping in touch with them and making increases (however small they may be) when we can, they will be more tolerant and possibly be cooperative with the whole idea of stopping the interest and charges eventually. We do have an emergency fund saved aside (due to an unforeseen bit of money coming in temporarily), but this is in a savings account and is not to be touched except in emergency circumstances, not to repay debts. If the fridge or cooker or washer were to pack up, we must have a way to replace them without using further credit (not like we could use the credit cards now anyway!).

We do get lots of post (seems like daily) from the creditors, seems like some send something a couple times a week. It's odd as so many say "we haven't received a payment from you"... when the statement does show the £1 token payment... it translates, I suppose, to "we haven't received what we consider an APPROPRIATE payment from you." There are a lot of "we may" and "it could" phrases. It's quite a lesson in reading between the lines. We're a bit terrified of the whole "going to court" thing.. we haven't reached that point, but I've read somewhere it's basically done by paperwork - that you don't actually appear in court. Is this true?? Any insight into this part would be a relief!

I finally decided to take on the overdraft, as it has both our names on it (other debts are DH's name only). I put enough money to bring it under limit, and am now making payments each month just enough to pay interest and a small amount of the balance. If, as is my concern, they dip into it to take money for DH's debts, then I will immediately contact them and see what I can do to avoid this. I also plan on lowering the limit on the overdraft regularly as I pay it off slowly.

Welcome to all the new people here! I have to say this DMP has finally made us feel like we're taking steps to improve our financial situation, although obviously it can be a bit nerve-wracking. Our creditors don't have our phone number, so (other than DH's mobile, which he rarely uses) we at least are not dealing with phone harassment.
