    dreams the bed company are currently doin me head in, bought a bed over a yr ago which has a warranty which hasnt run out, its one of those 'astro space' technology bed that shape to your body to give u extra comfort. ie cheap imitation of tempur i have come to believe.thing is,mines doin my back in, initially when the bed was bought, it was all they said it was,i conceived on that bed, but now, it doesnt hold my weight anymore.which sucks,instead of mouldin, it creates an indentation.....nyways,contact dreams they come out, and all they could come up wit is that the bed has stains so invalidates teh warranty...i mean how does stain,suddenly cause the moulding to ones body technique disappear, this is wot i asked the dreams lady in my email,but havent heard from her again..... anyone had any similar problems and how have u dealt wit it?
  • Having had an unfortunate experience some years ago with purchasing timeshare and holiday club membership in Tenerife which has failed to deliver what was promised, I am now wondering whether I can at least reclaim some of my money as I paid the deposit on credit card. Has anyone had any success with applying section 75 in this sort of situation? What would you advise?

    My first post so hopefully in the correct area.....

    I have used section 75 in the past..... with barclaycard quite a few years ago now - I am not sure if this was enhanced cover or not - I certainly did not pay for it?

    It covered (within 90 or 100 days) any loss /damage (even if accidental) /theft no matter what the circumstances - I managed to claim for a second hand bike that turned out to have a number of faults.

    So my question is :
    What does buying with a credit card protect during this period under the credit consumer act?:
    Theft?
    Accidental damage?
    or is it just as described in this forum - i.e failure of the equipment/ failure of the supplier in some way?

    I just ask as I have contacted Smile (co-op) about a theft not covered from my baggage on any other insurance - and they only mention cover for failure to deliver from an online retailer etc.

  • Better still you should be aware that the Lords' decision applies equally to foreign holidays purchased by credit card. So if you suffer loss or injury on a holiday abroad then you will be able to bring your claim for breach of contract in the UK courts and avoid the hassle and expense of pursuing a claim abroad.
  • I ordered a part for my motorcycle from a US company over 3 weeks ago. They said that it was in stock,would be dispatched within 2 days and I would recieve it within 5 working days. I paid by M&S credit card to the value of $2565 which after the credit cards 'conversion' rate turned out to be £1350 !

    I kept checking the webiste and after 8 days it had still not bee dispatched so I sent them an email asking about the delay. After 3 emails they replied saying there was no problem and it would be sent 'In the next 2 days'. A week later and it had still not been sent so I sent them more emails and got a reply stating that it was being posted last monday (22nd January).

    I checked their website daily and on monday it had still not been sent so I contacted M&S Money who said they will send me a letter ?

    After another 3 emails to the company I still have no reply and it has still not been sent and the card is due to be paid in less than 2 weeks.

    I do not want to pay for something that has not even been sent.

    Am I entitled to a refund and will they give me the full amount back or will they charge me the exchange rate difference that they charged on the purchase which was about £60 more than that days rate ?

    I have no faith in this company and no longer want the product after all this trouble, where do I stand ?
  • I'm in a similar situation as above.
    I bought from BestPricedBrands.co.uk and assumed it was a UK company from .co.uk address.... How wrong I was! They're based in the US!
    After hours of research and I foudn the website to offer the best price, so I ordered a camera on 5 February 2008 and paid with MasterCard. (£144)

    I received a confirmation email immediately and a UPS tracking number. The expected delivery was 7 Feb.
    UPS tracking states "billing information received" which means that they have received the package information but may not necessarily mean they have the package. The status has not changed since 5 Feb.
    I sent the company many emails asking for a reason for the delay but so far I have been ignored.

    How long do I have to wait until I can take this up with the Credit Card company?

    I do not want the product anymore as I have no faith in the company. I don't trust them to send me the right product in full working order anyway..
  • Hi, I just stumbled across these forums and would be most grateful for your advice regarding counterfeit jewellery. In February, I went to Cambodia and purchased what I was led believe was an 18k white gold and yellow sapphire ring. I currently live in South Korea, but am a UK citizen and purchased the ring using my UK RBS Visa. The retailer gave me a certificate of authenticity, which I have kept along with my credit card receipt. The cost of the ring was over £400. Unfortunately, I have since discovered the ring is counterfeit, and would very much like to claim my money back. I contacted RBS but to my horror they told me that since I accepted the certificate as proof of the rings authenticity, there is nothing that can do to claim back my money. Is this true? I thought that on the contrary, the certificate would be proof of fraud?? Any advice on this matter is very much appreciated. -Jeni

    oh my gush,some of those stories sound like fraudulent companies have set up...especially the .co.uk address based in US.i hope someone can give advise on these instances,so at least the rest of us can learn a thing or 2.

    I desperately need your advice. I am a victim of the Wrapit wedding list company that will be going into Administration on the 4th August. I am not sure if you are aware of the situation but basically it is a wedding gift list company whereby you set up a list, your guests buy you a gift from the list, then you close your list after your wedding and wait for your gifts to arrive.... none of them did). I am trying to advise my guests how to seek refunds. Most of my guests paid by Visa Credit card and therefore I will get them to seek a refund under section 75, however some of the gifts were under the value of £100. Is it worth me getting them to try for a refund from their card company? My next big problem is that 50% of my guests were French and therefore paid by a French Visa. I have asked them if their card is a Visa Credit or Debit card but I am not sure if a French Visa Credit or Debit card has any protections in situations such as this where they have bought over the internet in a foreign country and the goods have not been delivered (and then the company has gone into administration). My final problem is a number of UK guests paid for expensive gifts by Visa Debit card. I have asked them to approach their banks under the chargeback facility and they have been told it is not possible or doesn't exist. What should they then do? I stand to lose thousands of pounds of gifts which I am pretty gutted about. Any advice very gratefully received.

    My car is in the garage and the bill is coming to over £3000, if I paid by credit card they wanted to charge me 3%, therefore stupidly I agreed to pay by cash. I handed over £1350 in cash as a deposit. I have to pay the remainder on collection (today). After reading about the additional protection on here I am thinking of having part of the invoice paid by credit card (£200?), will this give me the protection that is talked about and if there are any problems am I only covered up to £200 or the full amount?

    Any help appreciated.
