    I paid for my daughter's wedding dress with a store card taken out that day (to qualify for an additional discount). The dress will not be delivered to the store till some time next year nearer the August wedding. I have now paid off the full amount on the credit card. I have heard that the store may be in financial difficulty although that is only a rumour. In these circumstances, what are my rights? I don't know if the store has yet ordered the dress or paid the makers. I am thinking of asking for delivery now just in case?
    If they go into liquidation nearer to the wedding and have the dress in stock by then, I could have difficulty getting it out!

    I am not an expert, feel free to correct me.
    My understanding of the situation is as following:
    • the store card was provided by some financial company
    • this financial company is jointly liable with the store under the Consumer Credit Act
    • the fact that you paid to the financial company using your credit card neither cancels its liability nor switches the liability to the CC company

    Credit card cover on overseas purchases
    Having legaly purchased a pack of 1600 cigarettes from a shop in Cyprus, They were found then to be counterfeit (ref manufacturer) On contacting Barclaycard I was told that they would do nothing because they only covered goods of value, more than £50 up to £1500 per "item" and they consider 20 cigarettes to be 1 item. Having always used my Barclaycard abroad because of the added protection! I feel cheated by this Play on Words. Can anyone please advise, thanks in advance

    Quick question about section 75 protection:

    I purchased a computer from a company and they have now breached the contract. Therefore, I am claiming compensation for lost time as a result of the breach of contract. I have sent the computer back, and the company is refunding me, but refusing to pay my expenses as a result of their breach of contract. The company says that I cannot claim off the credit card company for my £100 expenses (2 days lost work, interest and phone calls) because they are refunding the whole amount paid by credit card.

    Is it true that the credit card company is no longer liable? I assumed that Joint and Several liability would cover it even if the company tries to get out of paying by refunding the credit card transaction?

    Note, I have not spoken to the credit card company yet - I will do later on tonight.

    I got a computer from MESH (retailer), screen continously faulty - got fed up they looked at it - agred with me - i asked for refund they said its not their problem go to manufacturer and not replying to letters. They still have computer on premises 3/4 mths later - wrote to credit card co who said S75 does not apply to computers(NAtionwide) recommending another replacement from manufacturer - so what happens now.... :confused - maybe just a refund is not too bad a deal goven my situation.

  • hi I went abroad to BHMS in budapest for dental treatment, they said all their work was guaranteed, they supplied and fitted a 9 tooth dental bridge. I now have speech problems and sound stupid when I have to say any word with the letter s. there is recess at the back of the bridge and I have found if I fill this with chewing gum my speech is perfect, which proves to me that the design of the bridge is faulty, they will not give me a new bridge and tell me that the guarantee is for workmanship and not for speech, which is a side effect. I paid them £1700 by amazon credit card can I claim this back from the credit company.

    I doubt it

    You would need to write to them with all the paperwork ( Disputes Department, Hbos Card Services, Pitreavie Business Park, Dunfermline, Fife , KY99 4BS) and let them review it

    The act only protects if the agreement is breached, if you have signed terms which state that this isnt covered then you have no claims, if this should be covered etc they may be able too

    The best idea is to send copies of all the paperwork and let them have a look at it

    Its too easy for amatuer lawyers to say it does etc but until they have read every part of the paperwork it cant be stated

    Guarantee will be reduced or invalidated under these circumstances:
    If oral hygiene is neglected.
    If dentists instructions are not followed (for example not wearing the dentures during the night).
    If removable restoration such as partial dentures or full dentures are not kept and maintained properly.
    If the patient does not visit a dentist for a routine check-up at least once a year.
    If the gum tissue or teeth bone is naturally reducing.
    If the patient loses or gains a substantial amount of weight over a short period of time.
    If the patient is in a general medical condition that has negative effects on the dental condition (for example diabetes, epilepsy, osteoporosis, condition after x-rays or chemotherapy).
    For temporary work, we cannot offer any guarantee services.
    After-treatments, such as removal of stitches after an operation or undergrounding a prosthesis, are not included under the conditions of the guarantee.
    When the treatment received has not been paid in full and all current accounts have not been honoured.

    on their site they offer 100% satisfaction, and say that you will have Improved speech.

    What does it say is covered, thats just a list of exemptions so means nothing

    Unless your paperwork states this specific thing is covered or has a term which reasonably can be interpreted to covering this your screwed
