    I'm being such a big baby I know but I'm in tears after ringing my doctors office to enquire about what week you get your MATB1 form and how to go about getting it (seeing as though my next and 2nd appointment with the MW is at 28wks).

    My employer was asking for it yesterday (Im 22 wks) and said I should have got it at 20wks plus it says in the company handbook that I need to have it in at least 15wks before my due date else it can affect your payments. I looked it up on the internet and quite a few people were saying 20wks so I got a bit panicked.

    I politely asked the doctor's receptionist for advice and she barked at me as if I was a complete idiot and should not have bothered her with ringing she virtually shouted "WE CANNOT FILL IN A MATB1 FORM UNTIL AT LEAST 14 WEEKS BEFORE A PERSONS DUE DATE." and continued to repeat this over and over when I was explaining I was just a bit worried as work was asking for it. If my next appointment with the MW is at 28wks that will be a bit late to start faffing over it and I'm wanting to leave work at the earliest opportunity.

    I know my hormones are making me react so but she was so horrible that it's actually put me off ever going back there.

    Edit: Ignore me, looked it up on the direct.gov site myself to check, and you don't lose SMP for a KIT day, you get it paid as extra, so still 5 days SMP plus what you earn for working.
    "you are entitled to do up to ten days work during your maternity leave without losing Statutory Maternity Pay (or Maternity Allowance if you are getting this instead) or bringing your leave to an end."

    I was told you get your MATB1 form at 25 wks. That's when I got it for both DS2 and this baby. I would call your midwife and explain that your work is asking for it and ask when the soonest is she can give it to you. If it's 25 wks, then maybe she can fill it out and leave it at surgery for you to pick up.

    As far as your work is concerned, as I don't think the form is given out prior to 25wks, they're being a bit silly. Can you just speak to them and say "look, I cannot get it before then, so if you're looking for a written date for when I want to take maternity leave, I can type up a letter for you so you have something in writing, and then when I get the form I will give it to you." (and if they're being a bit wretched about it already, I'd make sure I photocopied the form prior to giving it to them, in case they lose it. )

    I know, it is horrible and stupid that work demand it before they can actually issue it. Make an appointment with your mw in your 24th week to get it and just give work a letter with your dates (EDD, when you want you ML to start etc) and tell them you will give them the MATB1 when it is issued to you by the MW.

    If you have a job, how come you are not entitled to MA? We're you not working long enough to qualify, or not earning enough - just checking you've been given the right info!!

    Thanks Triggles and tia, I think my employer is a bit clueless to the proceedure as my boss did say that they haven't had a pregnancy in that particular department before. I'm pretty clueless too, I know, but you do tend to feel like time is passing by and you're in the dark a bit when you don't see a MW for so long. I'm sure it will all work out and will definitely try to make an appointment before the recommended 28wks.

    It's not a busy surgery and there is more than one receptionist so I don't know why she was so nasty when I had said "sorry to bother you" and asked a pretty short question she really barked at me!

    I've just found this on the hmrc website which seems to say that you will still get SMP for the full week if you work a KIT day, but then it is between you and your employer whether they pay you any extra wages for it? p26

    Hi Fidget,

    Your Dr's are telling you complete porkies, you can get the MATB1 anytime after you are 20 weeks. Your employers need the form by the end of your 25th week so they can work out your maternity leave/pay. Maybe if you phone the antenatal clinic at the hospita they might be a bit more clued up? Dont leave it till 28 weeks anyway, your employers can tell you its too late!

    ps, when you get the form - make sure you take a photocopy of the front and back, employers are notorious for losing them and the midwife will only issue one!

    edited to say, I would complain about that receptionist, who does she think she is giving you completely incorrect information and having the nerve to make you feel bad for asking a question!
