Either way, I would accept that this was an accident and help your Mum. But make sure that the store has filled in the accident report form and that you follow it up with the results from the hospital.0 -
You're not over reacting. They are liable, I knew someone who fell over an upturned basket (her own employer) and cracked her spine. She made a claim & continued to work for the company. She ended up having to have treatment for quite a few years after though.
I've worked in supermarkets and if you see a spillage, you're just not allowed to leave it. You have to call or wait for someone else to get a cleaner.
I'm not saying go call Claims Direct, I just don't agree with all the people making excuses for the supermarket. If it was a knife on the floor and a child had fallen on it would you all still be saying "it's her fault, she should have seen it, get over it etc"?
At the very least, send them the bill for the dry cleaning.0 -

I saw the person's bag break, and my mum was at another till that was nowhere near the spillage. We were both in the store but I wasn't next to her. What part is confusing?0 -

Put in the formal complaint and make sure you follow it up. I'd be really upset too if that had happened to my Mum. Putting an upturned basket over it is just turning a slip hazard into an additional trip hazard. They should have had someone standing by until the area could have been properly and safely cleared.

They filled out an accident report at the time, and my mum asked whether she should let them know how she got on at the hospital - and they said no!
The paramedic noted on her report that there had been no hazard warning sign by the spillage.0 -

AS I have previously mentioned, I was in the same store as my mum - just not standing next to her. So it was pretty difficult to warn her I didn't know where in the store she was.
And I'm sure many pensioners would fail to seen an upturned wire basket.0 -
