I spoke to royal mail again and they have confirmed they tried to deliver them twice and got no answer so i cant claim compensation from them. Given this information would the buyer be likely to be able to claim back on paypal? Since it was obviously their fault they weren't delivered.

I would be thinking about asking the buyer to confirm the address they should have gone to.

Something about this story isn't adding up. How could the buyer miss the RM TWICE?
    My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

Did you ask RM why they did not leave a 'while you were out' card? How would the purchaser know the item was delivered (twice) if no card was left? I think this is negligence on RM's part. Ask RM to investigate which postie attempted delivery and why no card was left.

I had a case of this however, the postie had incorrectly read the address (even tho it was clearly typed in BOLD) and did not bother to leave a card either.

I complained to a senior manager and recevied full compensation. In the meantime I would suggest refunding the ebayer - they bought and paid in full confidence & are not to blame for RM negligence.

Immediately fill in a compensation claim here with RM http://www.royalmail.com/portal/rm/customerservice2?catId=69800733&mediaId=70700722 as it can take up to a month or more. (they will need to write to the buyer to confirm delivery was not made)

Don't give up you are entitled to a full refund.

Here is a table of RM's compensation for Special delivery
Special DeliveryBasic compensation for actual loss:Up to £50 for the 9am service and £500 for the Next Day (by 1pm) service or the market value whichever is the lower and the fee repaid.

Enhanced compensation is available at time of purchase for £1,000 or £2,500 at an additional cost.Evidence of posting is required. Claims must be submitted within 12 months of posting.

Consequential Loss for up to £10,000 is available to purchase at the time of posting at an additional cost. Evidence of Consequential Loss purchase is required. Claims must be submitted within 14 days of posting.

As we're not 100% sure it's RM negligence, then I think it's unwise to refund the buyer at the moment.

For all we know, the buyer changed their mind, ignored the posty, and pretended they didn't get a card.

Get the RM to investigate first, and get them to speak to the postman who delivered the tickets.

Saying they attempted 2 deliveries sounds really odd. Perhaps the card was left with the neighbour?
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

I've spoken to Royal Mail again and it now looks as if they sent it to the incorrect address. It was a block of flats and Royal Mail are saying the way it was addressed was incorrect (however I wrote it in the exact same way as what it said on paypal). Do you think its worth pursuing with Royal Mail? The buyer has good feedback previously and i am assuming that most other people who have sold things to him on ebay will have addressed his address in the same way.

The buyer can't do anything Paypal-wise to try to get their money back. You've got a tracking number to prove that the item was sent to the Paypal address, and that there was no answer when the postie knocked.

If they open an item not recieved claim, just put the tracking number in and let Paypal take care of it.

royal mail said it should have been

    flat 5
    5 cornation street

and there was no such thing as block 15

the buyer said they get mail all the time in the format like i sent it

and here is the classic problem of the postie delivering incorrectly addressed mail
i usually mark these items asking the recipient to correct the address, most never bother
the 9am would have been given to a van driver most likely who would have not had a clue where the buyer lives and just that they couldnt find a block 15
if the regular postie is off then they wouldnt know where to try

what does a post code address search on RM's site show the address as?
