    his wireless was not encrypted till recent...

    Send them a letter stating that you haven't downloaded it, and it is possible that someone else used your network to do it, as all routers come without encryption enabled.

    If you are using file sharing, I suggest you turn it off now.., and delete any files you have on the HD..

    thanks everyone i appreciate your kind views....hes sure that he didnt not 100% though as it was in may and he dont use mcafee...anyway if he says that what can they turn around and do?

    McAfee or Norton?

    The thing they need to to is to get in contact with their ISP.

    They need to find out if this law firm have contacted their ISP and why their ISP gave out their details. If the law firm have not contacted their ISP then they need to go to the law firm and ask them how they can prove it is them. No one knows who the owner of an IP address is except their ISP.

    ISPs are not obligated to give out any details to anyone without a court order.

    Also your friends computer may have been infected by a trojen and been acting as a dummy node, can they prove it wasn't?????

    Maybe time to reload your machine too - some free utilities available for DoD hard drive wiping - no logs or traces left on the computer, or for $40 or so buy a new hard drive oad up the software and keep the other as a backup - don't make life easy for them - if you fight it and they cease your computer its going to be much harder for them to prove anything

    keep it as a backup but dont keep it at your house, if they search your house they will find it and use it.

    As far as I was aware, just an ip isn't enough for court action is it? Purely because they can prove it was you.

    A lot of posts seem to be talking as though the letter is genuine. How have you made absolutely certain you are talking to a genuine law firm (from a number they have given you?). If they didn't do it I would ignore it and treat it as a scam.
