I'm really pleased for you that you won the case with the CSA.
Does that mean now NRP has been proved habitually resident in UK by the CSA, case is now still within CSA jursidiction, are they now pushing for maintenance? Are you continuing with REMO just to see who is successful first in collecting the maintenance.
I have actually give up on the REMO process until I have read the posts over the last couple of days from you all and I might pop in to the magistrates for the 10th time and see if anyone has wised up about this process yet! Not over the past 4 years they haven't.
Can I just ask, you know when you give REMO the NRP address/details how do they actually get proof that he is in that country? You know like the CSA just accept whatever the NRP tells them where they have moved to, they do not verify it, just prove they're not in UK and close the case down.

Yes, this is backdated to when NRP stopped paying!As his income is foreign, it will take me some time before the CSA and I agree how much he should pay monthly. Currently, the law does not acknowledge foreign income. Are you continuing with REMO just to see who is successful first in collecting the maintenance. Yes....but not heavily pursuing it. The REMO country have had 2 meetings with the NRP, so I know they believed the address info that I provided. I also knew his work address too, and provided that. I'm lucky in that he is in a very specialised field and you can track him down by his job, anywhere in the world.

I would just encourage every PWC to perservere! Weekly letters to your magistrates court requesting updates from London REMO, and they'll soon get fed up with you! I noticed that when I copied London REMO into my letters to the magistrates court, everything got actioned sooner.0 -
After hearing from Liverpool in January i had diaried to email them next week as London confirmed Florida had had the info in December.
However through the power of facebook i learnt that nrp was going to NYC for a job interview.
I emailed liverpool and asked if we could let Florida know asap as even though his employment history isnt great i didnt want him doing a flit to NYC without an order being put in place
I had a response and was told the Florida had contacted NRP on 6th January to confirm his address???? I thought they just went ahead and served him. !!!!!! is that about??
I am waiting for my copies of the documents from Liverpool/London which i hope will come tomorrow or Monday.
I am starting to doubt this. If the bloke is willing to state hop to avoid child support despite his father being close to death i dont know what he is capable of
Does anyone know that if an order is put on in Florida does it go through the child support department there so would be linked to his tax refund if he got into arrears???0 -

They'll get him......one way.....or another....
One of the sanctions that they have in place is interception of any federal funds. This includes tax refunds - as every year in the US they have to file a tax return, and so is traceable through that wherever he decides to move to.
They do need to have confirmation that he is residing in Florida - as they have to determine whether the courts in Florida actually have jurisdiction over the case before they proceed.
Do you have an order in place already and are just going for enforcement? Or have you applied for an order or a variation? If the order is in place and you are going for enforcement, once they realise they have jurisdiction, it will just go through the court and he will be notified of it being registered there.
If you are going for a new order or a variation, he will be summonsed to court for a court hearing. There he will get to give reasons for his not paying or whatever he's wanting to say to the Judge. He will then be slapped with an order from the judge and it becomes enforcable immediately.
I don't know how they enforce it down there, but Canada has an 'enforcement agency' that you then register your order with. They will put into effect any enforcement measures that they have the power to do in order to collect arrears and current monies owing.

I guess you could always pay the witness fees to summons a witness to the court here with you to testify under oath the whereabouts of their son, brother, daughter, sister etc.?0 -

No family in the UK and long gone of the scene. Only the CSA know the NRP's whereabouts. But if he flits abroad, then ?0 -

I need an order sorting first as we have nothing in place. I read about the tax intercept. Sounds great, pity it wasnt sorted for now tho as he has claimed ( for the 10th year) the children he doesnt support and who have not spent time in the USA for 7 years as dependants on his tax returns. Nice guy hey? Considering they have been giving for the past couple of years a child tax rebate of $1000 per child. That the children its for havent seen.
So now they have established his address do you think they will have him served to appear in court??
Pity it was not expected that look on his face would have been worth seeing. lol0 -

Off for half term so phoned the courts as he hasn't paid anything this month, my paperwork's been sent to REMO but the judge had put on the form he completes that I hadn't supplied a photo but he was letting it go - duh there's 2 photos of the not so handsome loser included in my affidavit.
Anyway the lovely lady found it and is going to point it out to the judge and send a copy to the Official Solicitor although she hasn't got a clue what happens next.
When we all get things sorted we should set up a business0
