    All i can say to try and ease your mind is the TV and computers if it looks like you have just went out and bought them because you knew you were about to go BR then yes the OR will have something to say about those but if like many people they are just things you needed at the time so went out and got into debt for over a year or so, like you say the OR will most likely not be taking them away,they understand that someone with a £10,000 debt will have TVs etc as part of their debt,and these are the things you need to buy and no OR will leave you without a TV, if like I say it was bought with the understanding that you were going to pay the debt back but now can't,and no you will not have to list them on your forms,and as for not knowing all the info to fill out your forms,I'm sorry but no one could have handed in forms with as much info missing or incorrect as me,you don't need ANY statments all you really need is the name of the creditor and the account number(I didnt even have an account number for 1 of my creditors, just put their name down)as the OR will be ringing them up to get all the correct amounts etc
    If a DRO is right for you then don't let the fact that if you get a job you will have to come off it put you off them as that is what they are for and by the sounds of it you want a job to be able to pay your debts,so it will take the pressure away until you get a job,so to me sounds like a good thing not a bad one,and 1 last thing sorry 2 last things,first,when and if you fill in the BR forms ONLY do half/one form a day so it will not seem so daunting and as you don't have a house or busness trust me you will find them not so hard as they look,and lastly look on this site to find a post where someone AFTER BR said they wish they never did it!that will be alot harder to do than filling in them forms.

    Hi,

    You dont need to list any of those items on the forms, they are all exempt. They are normal household goods for the reasonable domestic needs of you and your family.

    The OR can get bank statements himself, if he can be bothered.

    Get help with the forms from CAB or on here !

    Hi

    The main CAB has a backlog over a month long so I saw a CAB adviser at my GP surgery.
    She said she could refer to the main office if she deemed my case complicated.

    Anyway, because of my computers and stuff, (assets) and the fact that I am determined to find a job she agreed a DRO would not really be suitable.

    We discussed bankruptcy and I told her I would leave that as a last resort.

    So, she has given me income/expenditure forms to complete as she said she will assist me in negotiating lower payments with my creditors for the time being.

    As my building society is one of my creditors and may freeze my bank account she suggest I open an account elsewhere for now for DD's and JSA payments.

    She said I should not go with the Co-op account for now but save that option as a last resort for if/after I do go bankrupt.

    What do you good people make of this advice?

    I fear the letters and calls will start as soon as we contact the creditors, sigh.

    I know bankruptcy may seem the simpler more straight forward option but I hold on to the hope of finding work and avoiding bankruptcy.

    Hopefully negotiating with creditors will buy me time to find work and at least they won't be able to say I am not trying to deal with things.

    Hi Merlin.

    I think it was more a case of me being against the DRO route as I am hopeful of finding work soon and if I did the DRO would be annulled and it would be money wasted.

    She was concerned about the computers as "assets" because I have 4 or 5, whereas one would be considered a normal household item.

    Appreciate the input.
  • hi there the cab told me that since december the courts have not been granting bankrupcy for less than £15000 and tell people to apply for a dro instead

    Hi the pup,

    Sos to hear about the issues you are having, they will get better. Just a quick note about calling CCCS. Are you aware that National Debt Line is free on mobiles? Therefore if you are concerned about having to talk in front of your daughter, couldn't you go for a walk in the park and ring them? They will also call you back if you are worried about calls. But I'm 100% certain that their calls are free - you need to call the 0808 number. Look at Debt Doctors sig.

    They were fab with me gave lots of advice.

    Sorry Miss Spooky....not many mobile providers would offer 0800/0808 numbers for free more than likely if you ring from a mobile they're usually charged at a standard call rate or slightly higher

    0800 numbers definitely aren't free from a mobile. :D

    Hi,
    When Martin was on gmtv a couple of weeks ago, he said that there was now a loophole with calling 0800 numbers for free from mobiles. you have to call a particular landline number first and then enter the free number and it won't charge. I am not sure of the number but sure it must be on this site somewhere ;);):D
