I have to repy tax credits, what can i do

As far as I know there is no such thing as married mans allowance-the tax credit system was what replaced that. You only get Child Tax cedits when you are in receipt of child benefit for those children. Child benefit has to be claimed-either after registering the child when a form is given to submit to claim it-or by applying and submitting proof or birth certificate if someone takes on care of a child later on.
When applying for child tax credits or working tax credit they expect the claim to be made honestly and accurately and it is stated clearly that it is the recipients responsibility to thoroughly check the award notice and report any inaccuracies quickly.
Believe me I am no fan of this system-they are demanding we repay a whole years award as they state we didn't return the paperwork one year,even though they have accepted our proof it was sent and admit we had no way of knowing it hadn't been recieved as they continued to pay us and we had no letters until they damanded repayment. However the system is there and we have to abide or face the penalties.
Maybe the next govt will devise a different system-doubt it though!Tomorrow is always fresh, with no mistakes in it!0 -
according yo your argument regarding being payed as a single man,
that means anyone can say on a form 'i have 6 children' one wife, and claim working tax credits and child tax credits , and the reason why, because the inland revenue of this department does not have access to your tax code and therefore is open to fraud
surely the inland revenue must know if a person is married or not ?
because i was paid as a single person, even though i was married, the inland revenue are more or less saying it was a fraudulent claim , fraudulent becuase of a mistake , not because i am a fraudster
i am now receiving married man's allowance
so they though it was a fraudulent claim, instead of being underpaid , which it was
the system is obsurd , they pay me x amount for married man's allowance , and im repaying the amount back to them through direct debit
as far as i am concerned , soon as ive payed them what i owe, i will certainly not be claiming working tax credits ever again
If you were or are receiving married couples allowance, then you either you or your spouse must be aged in your 70's or above. Are you? If so then you've certainly had your children late in life, and are keen to work well above the retirement age. Gee, yuo must be exhausted working over the required hours to qualify for WTC and running around after kids at your age!
Married couples allowance is payable only if one of the partners were born before 6th April, 1935.
It was abolished for younger couples on 6th April 2000 by the Labour government.
So I'm afraid that unless you or your partner are aged upwards of 74 then you are just digging yourself a deeper hole. Your story is seriously lacking in credibility, with more and more holes appearing every time you post. That is what I mean when I say you wouldn't get far in court.0 -

In that case you can't be receiving married couples allowance, as explained above.

I have received today from Her majesty's revenue and customs notices with my wifes name on and my name stating that my wife is claiming from the above name which is me. so i am claiming married couples allowance0 -

You might have received it from HMRC but it most definitely is not Married Couples allowance (MCA). Married Couples allowance is an extra tax free allowance given to taxpayers who were born prior to 6th April 1935. It is administered through the tax code applied to your main source of PAYE income.
You may however have a joint tax credit claim with the Tax Credit Office, which is a department within HMRC, and the elements of Working Tax credit you are entitled to as a couple would include the Basic and 2nd adult elements of WTC.This is a system account and does not represent a real person. Just as Pam says. It cannot possibly be married couples allowance.
There are several things that can be claimed from the HMRC, not solely married couples allowance.
People can also claim benefits from DWP for their partners. That doesn't mean they are receiving married couples allowace. Being named as the person who is named within another individuals claim does not amount to the receipt of married couples allowance.
