if the repayments mean you suffer severe hardship i think that they might re arrange them for you. have you rung to tell them that you cannot afford to pay htis?

You do need to ring them, explain re hardship and negotiate down. Are you sure they overpaid you/have you checked their figures? If they aren't playing ball, you can go to the CAB and ask them to negotiate on your behalf, and if that fails (which I doubt) get your MP involved as they have a hotline for CTC complaints. In rare cases where it goes to court, the court would in any case look at your financial situation and often impose a peppercorn repayment and they know that so if you offer what you CAN afford often they know this is better than what they would get from taking you to court. Good luck and DON'T STRESS!

    OKAY, new question

My friend also payed his back, BUT he wants his money BACK, that he repayed to them. He repayed over 10 thousand pounds back in total.

How does he get some of the money he payed back to them back ?

and they accidently overpayed me because they thought i was a single man, but i was married with 3 kids, so they got their records wrong.

How ridiculous, to just assume you can 'sue' or 'get your money' back. The only people who deserve to have overpayments remitted are those who have genuinely suffered and been overpaid due to errors that were not their fault. People disputing for the sake of it because they don't like the thought of repaying money make it more difficult for people who have a genuine reason to dispute, because the tax credit office are busy sifting through the disputes of people who were overpaid because they were at fault.

Does your friend deserve any of the money 'back'? Why was he overpaid?

How could tax credits 'accidentally' think you are a single man when you had a partner and 3 children? Did you inform them you were single? They do not create claims based on information plucked out of thin air. 'Getting records wrong' is mistyping an income or accidentally deleting information, 'getting records wrong' is not someone in a relationship making a single claim for a benefit. Did you ever wonder why your wife and children weren't present on your claim? Did you in fact ever inform tax credits of their existence? How long did you let it go on for?

Please don't waste the time of the tax credits office with a dispute if it is your own fault you were overpaid, their time is better spent on helping people who have done nothing wrong.

Well if they were paying you as a single man, then surely they were underpaying you??????????
