Sorry to be a pain but I am revisiting this as I am about to start the application for finance. I'm assuming nothing has changed, but the website no longer refers to UK students returning from EU, ie I can no longer find this quote which applies to me.
was settled in the UK and ordinarily resident in England but left to exercise a right of residence elsewhere in the EEA or Switzerland,
and
is returning to the UK to start a course on or after 1 September 2008

When I asked Student Finance about this last year, using the advice you kindly gave me, I specifically asked, should I apply then as if my daughter is already living in back in the UK, using her UK address and they said yes we should apply on line as a UK student.
However, the on line application asks if you have been living in a country of the EEA (European Economic Area) other than the UK for the three years immediately before the start of your course.
If you answer yes to this, you are told
Sorry, this application isn't right for you
You have indicated that you have been living in a country of the EEA (European Economic Area) other than the UK for the three years immediately before the start of your course, and are not considered to be one of the following:
a refugee. or the family member of a refugee
the child of a Swiss national
an EEA Migrant and Frontier worker, or their family member
To apply for student finance you have to download an application form, you cannot use this online service.
The application form, and other information on student finance, can be found on the EU Students' page
If you are the child of a Turkish national who is resident or lawfully employed in the UK and you are ordinarily resident in a country of the EEA, Switzerland, and/or Turkey, you can apply using the PN1 form available on the Forms and Guides page.
and basically re directed as an EU applicant, which means we can only apply for tuition fee loans.
We don't want to answer dishonestly, but is the key in the word 'immediately'. If we put ourselves into August mode, when my daughter will be living back in the UK, does that mean we can ignore the three year thing and just answer no?
Really appreciate your help on this.

She applied for maintenance grant but was refused on the basis that you can only get it if you start a new course from year one. However, before she applied, she called Student Finance England and were told that as long as she changes her course and she has the criteria of 3 years residency in the UK, she should get a maintenance grant.
Can she appeal? do you know of similar cases?

Did she get the maintanence grant in her first year?
When filling out her application form is she applying as a new student or a continuing student?
Has she asked to be income assessed?
From the details you've given I don't see why she wouldn't be entitled to the full student finance package as she received in her 1st year but perhaps there's something else which may cause problems.

A full study pattern, detailing years in which she was at university and the year of the course would help.0 -

Indeed, should be "or". My advice would be to ask SFE for a paper application form for full support, not the EUPN1/EUPR1 forms.0 -

She didn't get maintenance grant in first year because she didn't apply.
She applied on the form provided and after being told by SFE that because she changed course it considers as a new one.
She also provided details regarding household income (she meet the criteria).

She didn't do any courses before 2010/11.
She started last year (2010-11), which is the first of 3 years in her Bsc.0
