You will receive the paper work from the insurance company and this will allow you till describe the accident by drawing little pictures and writing a description, the insurance companies with then decide fault, if you decide not to accept their decision you can fight it and it will more than likely go to court, if you have legal cover this is not a problem if not it could be expensive. I understand that a lot of accidents are often decided to be 50/50
    Something like this?

All said there was a dire shortage of staff and beds, with GP patients and “ordinary” emergency cases regularly waiting for hours in casualty, or being kept in corridors or ambulances.

i witnessed this a fair bit when i was in hospital, i have been in and out of hospital recently with kidney inflammation, without a correct diagnosis i could end up suffering renal failure
things arent the way they were before, you wouldnt even recognise me anymore- not that you knew me back then ;)
BH is my best mate too, its ok :)

I trust BH even if he's from Manchester.. ;)

If shes not insured the insured driver (my DD) is covered anyway (I thought they had a pot for this)?

Thats exactly what happened to my DD, some idiot ploughed into her.

if your daughters front end collided with her back end , then was it not your daughter that ploughed into the other car ?

i dont see how an insurance company can decide who is at fault fully.
i hope everyone who is involved gets on the mend soon

Well they collided, but only because the woman turned right in front of an on coming car.

You really don't see how an insurance company can decide who is at fault?

If you are driving down the road & want to turn right, you have to wait till there is no on coming traffic, you can't just swing out into on coming traffic, that causes accidents, you are driving into the path of on coming cars, whom have right of way.

The other woman is unlikely to deny liability anyway, and even if she does, her insurers may well decide to ignore her and deal with the claim anyway.

The only point that I would consider is:

As my DD was approaching the junction (well left turn, do you need a X for a junction), two cars crossed safely in front on her, with plently of room, I guess this lady just followed them, assuming it was ok.

Now, it could be that she was travelling too fast for the circumstances (ie not taking account of vehicles driving across her path, even though she had right of way, and slowing down in anticipation that someone else may turn), or that she was driving very slowly, and this was just a minor bump (but the fact that she didn't brake in time and hit the rear nearside of the other lady's car suggests she wasn't).

I think the insurers, if pressed to do so by the other driver, may well investigate liability a little further, but in all probability, she will hold up her hands.

However, as none of us, including the OP, was there, we are relying on what the girl told her mum, so we don't really know.

All the OP can do is to get her daughter to give her side of the story to the insurers and see what develops.

Was your daughter indicating to turn left?

Had she slowed down? as she should have done because she saw 2 cars turn in front of her and another waiting.

What speed was she doing and what was the speed limit?

    What were the road/weather conditions?

On the face of it, it looks like the other drivers fault but all the above need to be asked and without witnesses, it could well be 50/50

All our family pay tax & NI, (my DD actually works for the NHS) so we are as entitled to use the medical facilities in case of need as anyone else.

Oh goody. I was going to say you can't use the NHS if not every member of the family pays taxes and NI, but as you (and all your family) do then please do feel free to use the health service.

From what I see here your DD isn't entirely faultless. However I doubt that is going to stop you running around madly finding someone else to blame. If an injury arises from an accident you can't (generally) claim for it unless the other party is entirely at fault.

Any driver should be able to stop in the distance seen to be clear with extra care at junctions. If your DD wasn't able to stop, then she was probably going too fast (given the sequence of events you describe).

I have had near misses with silly young drivers in little cars belting along (lurched forward in the seat, i've never understood why so many of them lean forward) without a care in the world but getting to wherever they have to be at any cost.

Has she done any Passplus/IAM/RoSPA courses in the two months since passing her driving test? I sincerely recommend those as they will help her confidence when it comes to getting back on the road after this incident.

No, three lanes, she was in the middle lane. She was going straigh ahead.

Had she slowed down? as she should have done because she saw 2 cars turn in front of her and another waiting.

She says she was just driving normally, with the traffic flow.

What speed was she doing and what was the speed limit?

The limit was 30 MPH, but its unlikely anyone would ever do that in a daytime in that part of Crawley anyway.

    What were the road/weather conditions?

    Nice fine day, dry road.

Its awful if someone can just turn in front of you without giving way & not be found at fault for that.
My guess is the lady "assumed" because the other two cars turned she could too & didn't look.
