DD had an accident today

DS was asked several times by his insurer if he was sure he was OK. He got quite irritated in the end!
Same for my son. He was a passenger in his friend's mum's car. Friend lost control, hit a lamppost about 6 feet in the air(!) and wrote off the 6-month old Fiesta. DS walked away with a skinned knee and a grazed shoulder from the seatbelt (I have no doubt he would have ended up over the railings and on to the motorway below if he'd not been belted in). His friend was dragged round to our house by the scruff of his neck by the parents!
DS was stiff in the morning - sore shoulders and very bruised knees and shins - but 4 days later, he did the GNR.
People were trying to encourage him to claim for his injuries. He was just pleased he'd walked away more or less unscathed. I was pleased that the experience would probably make him a careful driver!0 -
Cars are designed to take a certain amount of impact and not collapse in. So if there's only a loose headlight and trivial damage perhaps the car did it's job and the person is lucky to be alive?!
I can quite see that the headlight took all the force of the impact, and that the driver is lucky to just have to take a week off work and take up the (valuable!!) time of the accident and emergancy dept of the hospital..."Love you Dave Brooker! x"

Don't forget to check out the expenses on the hire car. And don't assume that you will get everything back from the 3rd party's insurer, even if the claim goes 100% your favour. That was a shock for us - we got most of the big amounts back, but not 'out of pocket' expenses (premium for hire car, a million phone calls at non-geographical rate etc). Apparently they aren't obliged to reimburse these
We kept our no claims as we are protected, but wouldn't have had that back otherwise.

Yep, I agree. I recently got my cars backside stoved in by an idiot that accelerated into me...
Now THAT's a BIG smack. I had backache and neckache for a few days, but it did it's job and TBQH I was just glad that both me and the other lad walked away. I'll bet he was sore as well..but claiming? Hell no. We were more concerned about passengers, and just glad the cars coped so well.
The lad was in shock..I was a bit. His passengers were as well - in the end we shook hands, exchanged details and as I said "it's only metal. It happens to everyone at some point - at least everyone's OK."
I could have claimed..I've had loads of people telling me to. But what would be the point? Do I need it? No. Does he? No. He'll be hammered for a few years for a slip of the foot..that's bad enough.
I had a courtesy car for a week..provided by my insurer. His insurer sent me a snotty letter 4 days later saying "you won't be able to claim costs because you didn't ask us for a car first". So I phoned my insurer, told them about the letter, and they laughed.
IF the other company had offered a) First, and b) in good time, it would be true. They did neither. They actually called me to query what car I had, and when I said, they asked WHY I had "such a high end vehicle" . I told them it was equivalent to the one their client wrote off..a 1.6 Automatic. They then tried to get heavy, and I'm afraid I lost my patience and told them where to go, also mentioning that they were on speakerphone and I was recording it.
They shut up quick.:rotfl: It was a 57 plate Golf 1.6 with a 6 speed tiptronic gearbox..£14k worth of motor. They HAVE paid as well..£70 a day IIRC.
I only kept it a week though..it wasn't mine, and the poor lad would be hammered enough. It ran me about while i sorted out a new car, and I gave it back. The guy was amazed when he fetched it..."People usually keep them for a month or more..".
Claim culture? Stuff it. The taxi driver on the first day was funny...drove me here, cost £5. He said "since it's for insurance, and you claim it back...what would you like me to put for cost? £30?"...when I said "be honest, it's OK" he shook my hand and said "well done, not many would do that".0 -
My car was rear-ended a few years back. I was waiting to turn right into a side road when an 80-something year old gentleman either didn't see me or just didn't register, he barely braked when he hit me.
It had passed the MOT a few hours previously which was annoying. :mad: I had neck pain which set in the following evening and lasted 24-48 hours. I also had a bruise on my shoulder from the seatbelt. My GP suggested paracetamol.
I did not consider claiming for the injury. My poor old car was destroyed but it was so rusty that it pretty much disintegrated at the back and absorbed all the impact. I have an acquaintance with the same type of car that suffered an almost identical accident, his car was in excellent condition and he broke his back in several places so I think I got off lightly!!!
Several people told me to claim but I'm just not into the compensation culture. I had suffered minimal physical injury, although the accident happened a week before exams and kind of screwed up my revision. But I just got on with it. People told me that the other party would have claimed off me had the situation been the other way around, he probably would have.
I briefly considered a claim several months down the line when it became apparant that the other party's insurance company were not going to pay out for my car (choice of car vs cash, I kept the car), in order to get any sort of money out of them. But I didn't. Never got a penny for the accident to this day.

Where, for example, is the message posted last night by "CrazyJamie" a Manchester-based lawyer? CrazyJamie had politely challenged Mrs E's version of events. But where is his message? And why was it deleted?
And where are the two messages, one from GoldenSpanners and one from me, again posted last night? We were discussing secure vehicle compounds - the yards where crashed cars are taken for forensic examination. Why were those two messages deleted?
There are many more messages which are now missing from this thread. I remember there were several postings about the long delays waiting for treatment at A&E departments, specifically at the ESH in Redhill and the PRH in Telford. Any reason they have now gone?
And where are all the case law citations from Bingham and Berrymans' ? They were crucial to understanding the arguments that insurance companies often use.
The person who deleted all of these messages should come forward and identify himself and should explain his reasons. Is he (or she) involved in some way with the original poster, MrsE?0 -
Well done to everyone saying they didn't claim for small crashes. Had a mate that openly admited claiming for whiplash when he didn't have any injuries whatsoever. He was always telling everyone how proud he was that he was going to get thousands of pounds for lying. He got found out. No money and up in caught for trying to obtain money through deception or something similar. Learnt his leasson.
MrsE, Afraid I need to sie with everyone else on this. If your daughter could see both cars turn and this other driver waiting she should have slowed down.
If there was enough gap for 2 cars to cross her road and another almost make it then there was definitely ample opportunity for her to get to 30mph.
Plus her BF in the car behind could see all this happening. Sounds like your daughter wasn't paying full attention to the road.

There's one who got caught! Convicted or not, the insurers will still record their suspicions over a claim in their Claims and Underwriting Exchange database. There were earlier postings specifically about this database, but those messages have now been deleted from this thread for reasons unknown....
As motorists, we all pay for frauds like this. The industry reckons that fraud adds £60 to the premium of every motor policy.
A new Fraud Act recently came into force. It replaces and simplifies many of the offences of fraud in the 1968 Theft Act. It is a very simple Act to understand. It is well worth reading for those contemplating a dodgy insurance claim.0 -

I agree, I read the posts last night, tho' I didn't make a post, deletion has taken place without apparent just cause in my opinion.0
