    I really really never thought I would be defending spa2k on this thread after the disagreements I have had with him in the past, but I'm going to have to here:

    In linzz's case, it's only R+R as two prices were displayed. You should have been charged no more than the lower price minus the £20 if you spent over £40 on other shopping. If the till forgets to do the deduction, it's shaky ground to claim R+R on the whole amount, but you might be lucky.

    Trading standards themselves won't take your call, you have to speak to Consumer Direct (0845 4040506), and you'll need some documentary evidence to show your case.

    It's reasonably well acknowledged that on multiple occasions, staff appear to have removed lower SELs. I would say this is definitely the minority of cases though, it has NEVER happened to me, as I always follow the staff back to show them the price. The same with offering the difference first unless prompted. This is not a global conspiracy, this is CS staff trying to keep the refund budget/target down as directed by some store managers.

    Ben you've got to chill out a bit here, some of your posts are just trolling now. This game is easy enough without needing to get enraged about it. By all means follow up with HO, and in the occasional case where the staff have been outrageous, follow up with TS/CD. In the majority of cases, provided you aren't taking the mickey, you'll probably get R+R.

    So are you going to tell us the time of day the offers expire now then spa2k? ;)

    Cheers John, I managed to bag one of these today. Waited until late in the day to avoid the cs staff who I normally deal with, nice young lad offered me the £3 difference until I offered my innocent "but when I've been overcharged at this store before ..." and got full r&r no problem.

    £12.97 R+R :T

    Hi Ben, I still think I may be right. As you are aware, operator errors are not counted as mis-prices under the policy (even though they are a mis price and therefore should count!)
    Therefore if Tesco are adament that this was an operator error then they are probably right to refuse R&R.

    As I said originally it is a bit of a grey area.

    Well i'm absolutely LIVID at the mo :mad: Just got back from tesco, and their healthy living chicken breasts are STILL priced wrong...the SEL stated £9.44kg but the pack price said £9.81kg.

    I bought 3 packets,took em to CS, waited at the desk whilst she went off to check the shelf...10 minutes later she comes back with a smug look on a face, clutching a shelf label that said £9.81kg!!!
    I insisted on going back to the fridge where i'd got them from, and lo and behold! the original SEL was gone! I told her it was obvious to me that she'd brought a new label to show me just to get out of honouring their policy, and she got really snotty with me.
    i had to insist on a straight refund for the chicken, took her name, and have just telephoned head office CS to complain...they're supposed to be getting back to me....well, better not hold my breath then, had I?

    Still, the kids say i shouldn't moan too much, cos we've already got 48 chicken breasts and 2 organic legs of lamb out of them this week cos they've never bothered to change the SEL until today.....so that serves 'em right!!:dance:

    Yet another example of why you should ALWAYS accompany the cs staff to the shelf, even if they don't want you to.
  • Hmmm, I wonder if you took proof (a photo of the SEL on with your mobile phone camera) which states date and time, and showed to them, whether this would hold up in such a situation? Just a thought I had. :confused:

    Nice plan, however Tesco does not permit photography within its stores without express permission of the store management....i'm sure that if you took a photo it would also show pre knowledge of the price you will be charged. Although this will not prevent an overcharge on Tescos part, I'm sure that your position would not be looked upon favourably when trying to argue for a refund if you produce a a photo. There is also the point of proving when the photo was taken, most people can change the time and date on a mobile phone....

    I'm sure it would. However it would also prove your intention was to get R&R because why else would you photograph things you are buying.

    I understand that first point of contact is through consumer direct but all consumer direct is is an equivalent of triage in a hospital and Trading Standards is where they will direct you. As for being chilled out I already am but I do however feel the need to point out when spa takes the opportunity to deliberately (or otherwise ) MISLEAD people who have fallen foul of Tesco [STRIKE]extortion [/STRIKE]overcharges.
