CSA Not Paying Maintenance

Hi There,
Im hoping someone can help and give me advice about my case.
I applied to the CSA back n december 2008. Due to my ex already having a csae with them and paying his other child, I was told that my case would be complicated and therefor would take longer to progress.
In febuary they called me to say they could not track down my ex partner even though he has a case with them.

The csa wrote to me in febuary stating that as of 20/02/2008 I would recieve £54.50 a week in maintenance. I declared this to income support as Im currently studying 3 days a week and doing 2 days work experience which I do not get paid for.

In march this year, the csa phoned me to explain that my ex partner was in arrears but made a payment of £109 which is 2 weeks maintenance.

In a further letter from the CSA, they state that due to this, they had sent his employer a deduction from earnings. According to the csa, the deductions must reach the csa on the 19th of the month, following the month the deductions are made(which I dont understand) and then they will pay me the money which can take 10-15 working days.

Well since that one payment of £109 at the end of march, I have had nothing since. In the mean time, my income support is being deducted by £34.50 a week which is right as by law, I am only allowed £20 maintenance on top of my income support. But I am now a lot worse off. Due to income support not making the deductions 4 weeks after my claim to the csa, I now owe income support £142 which is understanable but how the hell am I suppose to when Im not getting my sons money from the csa.

Due to the csa not paying, Im now overdrawn with my bank, behind with all my bills and really strugglying.

I have sent letters recorded delivery, called every week only to be told you have come through to the wrong department, when i do ring the right department, again im told the same story. I have sent emails pledging for a senior member of staf to look at my case but i have had not one reply or response.

What am I suppose to do? Income support will not stop my deduction of £34.50 a week and we are now in mid May. Its making me so ill with worrying how Im going to cope and get through. I was told i would be better off by £20 a week which would of paid for my sons football training and swimming but I am so much worse off as Im having my income support deducted. When I spoke to someone today from the csa, I was told they will eamil the debt department of the csa and get someone to call me. They said this over a month ago.
Im at my witts end and dont know what else to do. Surely this cant be right. If I had known I was going to suffer like this, i would of never applied to the csa as that £34.50 would pay my shopping and some bills as I have to manage on what money I get. I dont have a mum, dad, uncle or aunties that can help me. Its left me so depressed and I need some advice as the csa are doing nothing.

    Yeah, close the case, you don't need his money , it is obvious he aint gonna make the task smooth and will prolly pack up work and play the system.

    If I close the case, will income support pay me the money thats been deducted? He has a very well paid job and did use to say to me, he would leave his job if i went to the csa. He gets over £2000 a month so he would be a fool to but Im happy to close my case if im going to have my money cut like this when im not getting any maintenance. Thanks for your reply.x

    dont close your case as you will lose arrears and i doubt very much that income support will pay you the money back!!
    Contact your mp, they will get things moving alot faster!! make you they know that due to the csa you are in financial hardship and living below what the government says you need.
    try not to worry about things, easier said than done I know but gettin yourself down over it wont help, you WILL get there in the end just perservere :)

    I didnt think MP's would help over the CSA. I thought they just helped with housing and stuff. I will look into finding out who my mp is in my area. You are righ, I am living below what I should. Fingers crossed it wont be forever. Its just hard right now as I cant take my son football training as he has gone through a growth spurt, well thats good in a way lol but he cant play footie as his trainers are to small. Im going to look in to finding my mp now. Thank you x

    Why would you hand out such bad advice to someone who is obviously desperate. :confused:

    One can not know if advice is good or bad until after the event, however it should not be ignored that some NRP's will go to great lengths to evade being unfairly treated by the system.
    From what the OP posted £2k a month is not much really once you deduct 30% stoppages and then another 15% of that, a life on the dole becomes attractive,

    the csa have not treated my ex partner unfailry, he has got away with not doing NOTHING for my son for 7 YEARS. He earns more than that as he does plenty of overtime, gets double for sundays and works in the public sector. If one man can pay money for drugs, then £54.50 a week for his childs upbringing shouldnt be to much to pay. If one wants to leave a job where they earn more than £2000 after tax and want to go on benefits, thats just very bad. Time will tell. But thanks anyway

    As Tamsin has said get your MP involved ( they should currently be falling over themselves to help people ;) ).

    You have been treated in a very shoddy way and you and your son are suffering because of it. Thats not acceptable.

    When did you get the letter about the DEO? Were there any dates of expected payments?
    If you got a letter in March, & then a further letter - let's say April. If the DEO was sent in April, & deducted from his wages in April, his employer have until the 19th of the following month to send the money in, i.e. 19th of May.

    If the DEO was too late to catch that month, your payment should be the 19th of June.

    Hopefully, the money is on it's way to you.

    YOu should ask the caseworker to contact the employer to check to see if the money has been deducted, and if not, ask questions as to why. If he is still employed by them, they should refer the case to criminal compliance to contact employer and find out where the money is.
