    If you were one of my customers I would have taken the time to make sure you had a suitable policy. I actually explain the Medical Warranty and read through it with my customers. The vast majority are not interested in reading documents so I point out the most important pages and let them know if they only have time to read part of the policy to read these pages.

    Unfortunately when you buy cover on the internet which I assume you have done the Insurers will have all of the warnings there and all of the relevant documents are available for you to read. A lot of people will either not read the documents or read them and not realise the importance of declaring conditons. If you buy over the phone they should read you the declarations as well, however a lot of call centre staff are pressured into making call as quick as possible so they will not ask as in depth questions as I would.

    My sales process is no different from any other decent broker and I have had no problems with people not disclosing medical conditions. If you want to reduce the chances of problems in the future it might be worth you popping into a local broker and taking cover through them. They can find the best policy and take the time to explain the cover and any medical warranties etc.

    Like I said the majority of Insurers offer a good service and will pay claims if the correct information has been declared. Insurance (Especially Travel Insurance) is incredibly complex and as you have found not declaring important information can cause major problems.

    In my case i booked the insurance over the phone. I maintain i was never advised of the pre-existing rule for non travelling relatives otherwise i would of told them of my fathers high blood preasure. I challenged the ic to listen to their recoreded telephone booking with myself and suprises suprise they dont record "Many" of thier calls,but they are adament that their advisor would of said it to me.I maintain he did not.Unfortunatly for me i cant prove it.
    Secondly i never received any terms and conditions with my policy.I also pointed this out to them.
    Finally i made another call to FIRST ASSIST TRAVEL on the pretense of obtaining a holiday insurance quote and suprise suprise i was not asked the pre-existing parent question again.When i pointed out this fact to first assist they refused to beleive me.Saying that all of their staff are well trained etc etc.
    So please tell me how am i susposed to win against a company who cover their backs with at every turn? and move the goalposts:mad:

    This is obviously wrong, I hope you have reported them to the FSA as they will definately take this further.

    If you had not had your claim resolved you could have recorded the call and given this to the ombudsman and they would almost certainly have ruled in your favour.

    Recordings cannot be used as evidence unless the other person knows that it is being recorded. So, make sure you make them aware.

    The Regulation of Investigatory Powers Act 2000 (RIPA);

    Personal situations
    RIPA does not prevent individuals recording telephone conversations for their own personal use. However, disclosing the recording to a third party (that is, someone who was not one of the participants in the call) without consent of the call participants is illegal. This means that you do not need to tell the other person that you are recording the call provided that you never intend to let anyone else hear it. If you want to disclose the recording, you will need the permission of the other participants.


    Yep make sure you make them aware lucky........I would probably record it, send them a copy. and inform them you are going to write to the papers.
