Parked in a restricted street during prescribed hours

  • Hi,

I received a parking ticket last month, for parking on a yellow line - apparently in a residential area during prohibited parking hours!

The only thing was , there was actually no sign to tell you what the prohibited hours actually were!!

After complaining in writing twice - and pointing out that unless a mind reader how was i to know this, if there was no sign - i received a letter on saturday to say my fine had been revoked :j
    Happy Days!!

That's nice. I had a really nice, slow cooked, pork loin chop last night.

Yes I thought it was a template letter as well.

So do you think I should reply re-enforcing what I previously explained, that I was delivering some goods for a friend at a car boot sale. Who would have an invoice for that?!

I think they meant 10 days to respond, and then 14 days after that payment would be due.....? (Surely)

An interesting view. I suppose it could be interpreted in that way and hence they may be misleading you.

I think what they are doing is extending the original discount period, as promised but for only 10 days not the 14 promised. 'Unreasonable' as a general principle in law.

You've added an extra angle to it now in that if they don't do as you think they mean, from the way it is worded, then that would be unjust as well.

Ridiculous request for an invoice. Takes no account of real life circumstance described.
I would just get a brief note from your friend to confirm the delivery and see what they do with that.

    More later.

Beyond that, if they refuse, then you have to decide if you wish to proceed. Once the discount period expires (and we still don't know when that is, LOL) then you wait for the Notice to Owner and make formal representations.

If they do give you the option of paying at discount again then I can't tell you what to do.
in these circumstances I would fight but you have to consider finances, how strongly you feel, etc and reach a balanced decision for you.

I hate these Council rejections of honest statements. You stand the risk of a criminal conviction for perjury if you lie so I strongly believe they should accept that you are telling the truth. Sadly Councils seem to assume guilty until you prove yourself innocent. It doesn't happen to armed robbers!

that said, let's be positive because they have shown a willingness to cancel and this may be an indication that their CEO obs notes are unable to contradict your story.

I'll resond by the end of the week, I'll get my friend to write up a quick letter, and I'll post them off.

Thanks again Neil, I'll keep you posted.....
