Thank you for everyones quick reply, I will be escalating the claim tonight when I get home as I'm not happy about the sellers attitude with me over this. I like to give people the benefit of the doubt but feel it is wasted on this seller.

She can't claim from the post office til friday as that will be the 15th day since it was posted.

Can I just ask if I'm entitled to the p and p costs or just the item price?

If/when paypal find in your favour, they will refund the entire amount that you paid - cost + P&P.

As a seller and buyer I have had an item go missing each way.

As the buyer I let them know and they got back to me asking to leave it a bit longer etc which is fair enough, eventually we both agreed it was never coming. As he agreed to refund in full and I agreed to respond quickly to the royal mail lost item letter so he got his compensation. As it is I still left positive feedback mentioning the item did go missing but the seller was very helpful etc.

As a seller I get a few e-mails of no items, I usually confirm the date and politely ask them that if they do recieve it please check the posted date when it comes to leaving feedback, most of the time it makes it late.

The 2 times items have gone missing they have been buyers with decent feedback so I have given them the benefit of the doubt and refunded and just asked that they to respond to the letter form royal mail for the claim, 1 left positive feedback and 1 never left feedback.

Bascially as soon as somebody starts pointing the finger at the other communications will breakdown. In all cases I have remained open and friendly and people have been the same with me.

I have only ever opened one dispute with abuyer for no payment, they bought 4 items (BIN) and quickly got to me saying sorry but they only wanted 1 of them. Due to this I went down the 'mutually agreed not to complete" route to get fees back without effecting them and got them listed again quickly. 3 weeks later they still hadn't paid for the last item... now they have an unpaid item strike.

Good move - despite all of their faults, there is no doubt that a name and shame could inundate them with bids from helpful souls who buy everything only to test their "not responsible for postal losses" line....

Although a quick search reveals over 71,000 active listings where sellers claim not to be responsible....

Yes, and with any luck it will be a huge number of dodgy sellers who either buck up their ideas, or leave the site to the rest of us decent sellers.

And I'm sure Martin won't object to the extra traffic!

Well, I have a new message, saying that Friday is the 15th working day, she says if it has not arrived by then then she'll give me a refund and then they'll claim through royal mail.... simples eh? Shame she didnt think of that a few days ago.

If she had of been polite with me then i would of been fine waiting but im not happy with her attitude towards me, as if I am a pain the !!!!, all i want is what ive paid for.

Will I have to play a part in her claiming back from Royal Mail?
