Item not recieved help! my seller is mad @ me!

OK, so i brought something a few weeks back and it hasnt a arrived, so i open a dispute (after sending hte seller a message which she didnt reply to), ive opened a dispute, more because i didnt hear anything from her, and now shes said that i should of used recorded delivery and that opening a dispute hasnt helped.

ive been using ebay for a few years now and i know that it is the sellers responsibility to get the item to me, recorded delivery or not.

i have told her that i'll leave it another week and that if i dont have it by then i would like a refund.

i suppose im only posting this for a bit of feedback since the seller is now !!!!ed with me, did i do the right thing?:confused:

    You have done the right thing. I have bought and sold on ebay for quite a while now, but had to go to dispute over an item that I id not receive. I had emailed the seller 3 or 4 times without getting a reply. I did state in the last one that if I had no reply I wold be putting the matter in dispute. I got a full refund and the item never did turn up.
    But you seem to have done what you could over this so good luck with your dispute.

    It was her responsibility to get the item to you. If she didnt reply and give you a refund you did yhe right thing.

    There seems to be so many sellers who think once they hand the item to the post office its nothing to do with them. Then they become unstuck when an item goes missing.

    Can't believe the cheek of this one - it's her that should have used recorded delivery, the way she sends out an item is nothing to do with you. If she wanted to send something out by recorded she should have put the correct cost in her listing.

    I have been put off selling on Ebay by the petty paypal disputes I have heard of, but if I did I would NEVER send anything by normal post!

    Make sure you don't close the dispute before you have either the item or a refund - I think you only get one shot.

    The seller had the opportunity to respond to your initial contact and did not - opening a dispute was the right thing to do.

    I would now be wary of the seller sending an empty envelope via recorded delivery, just so that she can now prove you have the 'item'.

    Can you not now escalate it to claim and just get your money back?

    It is now more than 7 days since payment, so that trick won't work thankfully!

    Escalating to a caim may be the only option, but it can take 2-3 weeks for paypal to find in favour, so may best hold out for a few more days to see if the seller sees sense and refunds voluntarily.

    Thanks everyone again for the replies. like i said i only opened the dispute more because she didnt reply to my message rather then not having the item. i have given her til end of next week and said if i dont have hte item by then then i will want a refund.

    she then said that if i recieve the item AFTER i get a refund that i must repay - im not saying i shouldnt do that but ive never had that said to me before, however i dont expect to get items for free!

    i have until 22/05/09 where i either have to escalate the claim or paypal will close it.
