    In this instance the seller has demonstrated that they do not understand paypal and ebay, therefore I have no faith in their ability to do the right thing.

    If an item fails to turn up then I always advocate contacting the seller first, most sellers may ask for a bit more time, but most understand that they will be refunding if the item doesn't show. A re assuring emal from a seller would be all I needed to hold off any sort of paypal claim. However, as soon as the seller was dismissive or indicated in any way they did not feel this was their problem I would go straight for a chargeback.

    thanks, they said that they will go to the p.o. tomorrow so ill when i get home from work 2moro ig i have no message (by then it will be 7pm) then i will escalate the claim. im rather relieved that she has already left me feed back!

    Don't worry, the seller can't leave you negative feedback.

    Well I will be leaving her negative I have received another email saying that it is my fault as I didn't pay for recorded delivery, she said that ot is not the sellers responsibility once its posted.

    I have replied correcting her on this and that if I don't hear from her by tonight I ill be escalating the claim - something she has warned me against doing. However as someone that has paid for something I haven't received it is my right to escalate my claim surely?!

    Why wait until tonight? With the attitude that the seller is showing, escalate now. Even if she hadn't already left you feedback, she couldn't have given you a negative, so you've absolutely nothing to worry about.

    Escalate now it will take a few days for paypal to judge in your favour if the item turns up in that time you can close the claim

    I do smile when the sellers that put this in a listing get a paypal claim against them. Muppets like that just make things harder for the decent sellers, so the deserve to be educated by paypal.

    After that email, escalate it straight away, and make a point of mentioning in the negative that Sellers are responsible if the item goes missing.
