how many nights can i stay over

  • i know but this is what happened..... i took it to county court as i thought it was unfair but they said the letter should never have been sent!!!
    Do you think i should seek advice about this then????

    you're probably too late to challenge - you have an absolute time limit of 13 months from the initial decision regarding the overpayment. did you get specialist benefit advice and go to tribunal or just to court? sounds strange.

    my friend has just had someone come to her house from housing benefit and told her that there is no amount of nights that she can have a boyfriend over to stay,, they said that if she had lots of one night stands with differant people that would be differant because they are not a relationship but because its the same person then it would be expected that if he stay over regularly then he should contribute to the household. they have even said that she must be working because they have seen her been brought home from babysitting her grand children on differant days
  • I think individuals from dwp and council depts get as confused about all this as we do,the real test appears to be if the couple have any financial links or/and the partner has his/her own accomodation.But I think as has been said many many times if a single person finds themselves with a partner who stays over they should talk to both the dwp and council benefits depts to get confirmation,and i would suggest doing that in writing

    My friend works for the DWP and its not abut the number of nights a partner stays over, but the amount of time they spend at your place. So they could be there all day and return home at night to sleep, but if they are spending more time at your home than theirs they are classed as living with you! All very strange if you ask me...

    I'd be interested to know how DWP actually "monitor" these visits??!! Do they send out "spooks" to "stake out" each claimant and then run checks on each visitor?

    lol, i know... i guess its when the partner starts contributing financially and someone reports them to the benefits fraud peeps!!! I'll ask her and see what she says. But once someone has been reported, they do exactly what you say.

    Yes, the DWP do have investigators who may monitor the claimants movements, check their financial records etc.

    missmontana, the decision as to whether a couple are living together is not as simple as how long they spend at the house, that is one of several factors that will be considered.

    The DWP and council now have access to our credit files and can see if anyone is living with you. There is a big drive on at the moment to see if anyone claiming 25% CT discount are actually living with someone.

    Monitoring of the claimant's movements would surely be more to find out if they were working whilst claiming.

    This thread is more about the crime of having a relationship whilst claiming, so they would be surely more interested in the movements of visitors!
