    hi this is what as happened to me, my booking with xcapewithus was made using a visa debit card, and the bank, halifax, say i am not covered for a reclaim from them ? can you please send me a copy of the news paper article you gave to the bank and i will try again for a reclaim.cheers steve

    the whois on a domain search for xcapewithus has all been altered on 5th may odd is than not ? or can someone enlighten me as to why mr miles is no longer listed as owner of the site

    I paid with a halifax visa electron card , i phoned the number for halifax banking which is 08457 20 30 40 and asked the operator about visa chargeback, she filled a claim form in for me over the phone and said she would send it to the relevant department, she also said that the bank that i was claiming from would have 45 days to respond. This was last weekend and i`m still waiting.

    Back from Spain this morning. No e-mail ever received from Xscapewithus so was oblivious of companies situation until arrival at first hotel, with 83 year old mother.

    Your treatment will depend upon scruples of hotel.

    Two hotels booked:-

    + Hesperia Centurion, Cambrils.
    Management acted admirably and let us have room at original rate. They
    even took the trouble to ring second hotel to inform of situation and make
    sure we had a room.

    - El Paso - Port Aventura
    Management acted horrendously. Tried to hold us to ransom by charging
    over double the nightly room rate we had previously paid. They also refused
    to give us letter required by bank (see below), saying that this was not
    their policy - Needless to say we did not take them up on their kind offer.

    Bank Chargeback scheme:

    Because room was booked on Barclays visa debit, they will refund money on production of formal letter from hotel on letter headed paper, confirming that they have not paid for the original booking and explaining how hotel had been informed of cancellation ie. - "goods not received". We may have to write off half of our money, but are hoping to get some back, due to the professionalism of the first hotel.

    I have the same problem, but spent £2,699 with them, I paid by Visa Debit :( Thought I wasn't going to be able to get money back, but my bank Lloyds TSB said that I should be covered as its Visa Debit and they are now in the process of trying to get my money back.

    Go back to your bank and ask again and be firm, as some banks do not advertise the following: On Visa Debt they use a system called "Visa Chargeback" both on the debit and credit cards. They apparently claim under section 75 of the consumer credit act, basically they go to the companies who has gone into liquidation etc bank and try and get the money back direct from them. If your bank still insists they cannot do it, threaten them with the financial ombudsmen. You should in principle be able to get your money back.

  • Does anyone know if xcapewithus.com is an "overseas" website? I think this means was it set up/is it hosted abroad? Not very good at pc/web stuff...need an expert!! If it is then its great news for all of us who paid on maestro debit card!

    hi, i'd also like confirmation of where this co traded. i've found a mallorcaresident blog which advices andrew miles as xcapewithus traded from camino viejo, de bunyola, edif rotonda asima, 15, palma de mallorca 07009 and also costa y llobera 11-6 `7181, palma nova, calvia, mallorca.

    on a bbc news working lunch item it states if a co goes bust there is an exception to the maestro rule (no chargeback) if you are an uk cardholder who ordered goods online from an overseas website you have a right of a refund. it goes on to describe an 'overseas website' as a website whose 'centre of operations' is outside the uk even if the website address ends with dot uk.

    anyone clarify further? :confused:
