I contacted my travel insurance company, Direct Line, to ask if i was covered under their policy to claim back a full refund, but unfortunately i was not and therefore could not make a claim through them.
I paid for the holiday accommodation with my Halifax Visa Debit card, so i contacted the Halifax Bank to ask if i could claim a full refund through them, as i always thought if by paying via a Visa Debit i would be covered if anything like this happened !!, But Halifax told me that i was not covered and therefore could not make a claim from them ??
I have also contacted Xcapewithus to ask if i could claim back my money from them but they tell me it is very unlikely.
I know £298 might not sound much to some people, and write it off as a bad mistake, but its a lot of money to me and also i don't think any company should be allowed to take your money in this way.
Is it possible for you to give me some advice on how i can try and reclaim my money back ??
Do you know of any one who i can contact to help me with my claim ?
Any help you could give me on this matter would be great.

I had the same problem, we booked a holiday to Salou for our daughters 21st birthday in june, we paid with our LLoyds TSB Visa debit card. (£1038)
When I received the e-mail from xcape with us informing me that that had gone bust I phoned my bank and ask if I had any comeback, initially I was told NO, I also went into my local branch but was told that I can't get a refund on a debit card. However like yourself I was not happy with that as I felt like someone had robbed me and nobody cared or wanted to help. I kept phoning my Lloyds TSB helpline and finally got someone who told me that I CAN get a full refund under the " VISA Debit CHARGEBACK SCHEME"
I wrote a letter explaining what had happend, and had to include copy's of my bank statment with the xcape with us transactions, the original holiday booking with the costs, the e-mail informing me that they have seized trading, a copy of the e-mail informing me that the booking is not honoured.
I believe that Halifax uses the same "VISA DEBIT CHARGEBACK SCHEME" as LLoyds TSB.
I would keep phoning or better still go into your branch and speak to someone about the above mentioned scheme, and demand your money back.
The good news is that I did get a full refund from Lloyds TSB, they received my letter on the 12th May and the money was refunded in full on the 27th May:j

On the 21st of March I paid £56.25 as a deposit to xcapewithus for a holiday to Ibiza. I later paid the remaining £318.75 on the 27th Apr. Luckily a mate informed me a few days ago that they had gone bust as I had either not received or not read the email from xcapewithus informing me of there liquidation. I rang the Hotel Algarb, who the reservation was supposed to be for and they instantly knew the situation when I mentioned xscapewithus. They told me all xscapewithus bookings had been cancelled.
I then rang the Halifax 24 hour Online banking (08457 203040) and explained the situation. They then proceeded to go through a form over the phone and told me that it would be submitted to the relevant department. Now I’m not sure if this was the “Chargeback” procedure that has been quoted previously as there was no mention of that, but low and behold, 2 days later I got my £318.75 back.
I rang them and asked them where the remaining £56.25 was and they informed me that due to the fact that that was longer than 60 days after I had made the “complaint” I could not get that back. I dare say I should have pushed a bit harder and got that back as well, but at least I got the majority back!

The deadline seems to be variable. I received my deposit money back from Alliance and Leicester, having paid with Visa Debit and that was paid to xcapewithus last October and that is nearly 8 months!
So, bazlington, get back to them quickly and get the rest of your money that you are due.:T0 -
I have received the administrators report with a covering letter stating a full list of trade creditors is attached to the report. However, there is no attachment. Anthony Batty & Co must have somehow forgotten to attach it.
Anthony Batty request information for the investigation of Xcapewithus directors. When this is received they make assurances that this will be submitted to the Department for Business. I hope they don't forget to do this like they forgot to attach the trade creditor list to the administrators report.
Can I use the freedom of information act to check that the Dept for Business do receive my information on Xcapewithus' pricing policy prior to their demise (my company has historical pricing data that shows that they were consistently undercutting all other travel companies and I suspect selling hotels for close to cost price to get money into the company quickly) and do carry out a full investigation of Andrew Miles and Xcapewithus?0 -
