i got phone call 6.30 this evening i have to attend a dhss medical

    I had a doctor come out today for my DLA renewal, he wasn't one of the supportive doctors at all. He was so stand offish and intimidating that i actually burst into tears at one point. I was due to have someone with me but unfortunately they couldn't get there, last min thing etc. The first doctor i had 3 years ago was lovely, he was so caring and genuine nice person but this one i had today couldn't even smile or look at me when he spoke to me, well he didn't actually speak he mumbled that i had to ask him to keep repeating himself, and to make matters worse he was the image of Harold Shipman! I really don't hold out much hope about not having to go to appeal.

    Make sure you note everything down that happened when the doctor came out or as much as you can remember! This way if you have to go to appeal and get the appeal papers through you can go through it and mark the discrepancies etc. It may be worth contacting your local CAB too - I had help from them for my IB appeal and they were brilliant, I wasnt the only one who complained about the doctor that did my medical either - so the more that speak out about mistreatment the better!

    poor you.Do complain.As hjb says they may have other complaints too.If they aren't told about the bad ones they can't know.

    Awww Helen hope it works out.

    Keep a note of what was said today.

    I am progressing with my IB appeal. Have got welfare rights helping me. Just waiting for agency to send me a copy of the report.

    Anyone been through an appeal recently? How long did it take to be heard?

    My appeal for IB took about 4 months - though it could only have taken 3 as I postponed the first date for tribunal that they gave me as I was undergoing more tests and didnt want the tribunal slap bang in the middle of them all which it would have been!

    Mines currently taking 4 months...and its the first date given. Its all a bit crap really. Currently living on £35 a week and getting myself into yet more debt just to live. I'd of been fine if they hadnt of messed about (Medical, PCA, putting things down i didnt say etc)

    £35 isnt a lot, if I were you I'd get a job.

    Ignore his comment, some people who are fortunate to avoid illness fail to know what its like.

    My experience of ATOS medicals is that they are looking for a way to say you are fit for work, they are not diagnosing your condition they are there to see if you are telling the truth and if you are that your condition really does stop you from working.

    Examples are when an assumption is made it is usually not in favour of the patient, like you use public transport to get to the medical then an assumption will be made you can walk to the bus stop, wait there, get on the bus and interact with the driver as well as count money, be able to be in a public area around people, when get of the bus able to find your way to the medical center and walk there. That is how easy it is to be percieved in the wrong way. So anyone using public transport if you are in pain or feel uncomfortable nervous shaky etc. make sure you explain it otherwise they will think otherwise.

    You are usually assessed from the moment you enter the front door to the moment you leave the building, they can watch cameras to see if people really do struggle to walk etc.

    Remember this is a one off interview/assessment they will go on what information you tell them and any visible evidence. If your condition is not visible so mental or invisible physical problem I suggest you provide evidence of a medical proffessional and show it to the doctor that way if they disagree with it they may well have to explain why. It is important to know that it works on descriptors and certian conditions automatically score more points then others and it isnt good when you undiagnosed as you may well end up been asked the wrong questions from the LiMA computer generated reports.

    You should detail how you are on worst days and possibly even exaggerate but dont just lie in aiming to say what they want to hear because if they catch you out then everything else that comes out of your mouth will be discredited, not only that its fraud.

    Usually the decision maker will hold the EMP report above all other evidence such as gp etc. so if the medical says you fit you will most likely be told you fit for work and payment stop immediatly, when appealing you get the option of claiming JSA which apperently doesnt affect appeal result but still need to sign on, or 20% discounted income support. Personally I think this is very unfair but they argue that they dont have to pay anything while waiting for an appeal and wont ask for it back if appeal rejects claim.

    I hope this advice is helpful for some people.
