My mother traded in her Peugeot 206 for a MGF 2 seater convertible. She thought the guy was really friendly and nice to her at the garage. She had the car 2 weeks and has decided she hated it, so she took it to another garage that is owned by a friend of my grandfathers... he done a check on the MGF and it had been written off in a car crash. It was repaired and put back on the road, however the person who sold it to my mother did not put this on the log book, which he should have done as he would have checked the car out on the computer before buying it.
The garage took the MGF for 1.1k trade in (it's worth 1.8-2k) and sold her a nice little 4 door car. 1 previous owner, 40k miles for 1.9k. She's really happy with the car and it looks imaculate.
I've told her to phone the first garage and threaten them with legal action unless they give compensation. She's a bit hesitant about ringing them.0 -
Well I now know why Cabot Financial wrote me a letter all those weeks ago. It was for a Barclays bank account which I held for about 2 weeks over 2 years ago.
I wanted to switch to Barclays and I was accepted but their opening process was woeful. I never received a debit card and only got a cheque book. One DD was switched (for TV Licensing) and, even though I had to overdraft, a payment was made. This incurred a DD and unauthorised OD fee. I phoned them to close my account and this was done. The charges continued to rack up and now I owe them £260!
Just rang Cabot to set up a payment of £10pm and they have suspended interest payments. At the minute there is no record of Cabot recording anything on my credit file.0 -

why are you paying mate? Put the account officially into dispute and then write to barclays explaining that it was not your fault and you are not responsible for the debt. Advise them you will take this to the ICO who will, take your side and enforce removal and closure of said account.
Mate, don't agree to anything and stick to snail mail so you have proof.... Barclays will write this off as it was not your fault!
Bottom line is that you were within cancellation period and the bank failed to open account in line with their own terms and conditions.

How would I put it in dispute? Is that by using one of those letters asking for proof of CCA? Or do bank accounts not come under this?0

date account opened
date you closed account
were you informed account was closed, do you have a copy of letter? what is the date?
have you got the terms and conditions still? (obviously no but gotta ask)
who is the DCA?
when was it sold to them?
is there a default registered? If not, what is showing (what status?)

The DCA is Cabot and they told me they acquired the debt in February this year.
No default is showing - the debt does not show on my CRA at all.
