    Has anyone tried asking a credit card company to remove a default in the agreement that you wouldnt claim any charges back? Or would that be a bad idea?

    That is only if the original ccj loader wanted to put it back on but they often don't - also, lawfully, they can't and it's easily removed. :D

    In Scotland the debt is statute barred after 5yrs since 1st missed payment so basically you missed payment in Jan 2004 - in Jan 2009 the debt became statute barred. It is not 5yrs from the date of last payment but the date of 1st payment missed.

    You'd send this letter: #69

    It pretty much tells them what to do. Like it or lump it, they have to remove the data because the debt has, if you like, run its course and is unenforceable. However, some CRA's will argue that they want to leave it on your file, in which case you issue a s.10 Cease & Desist letter (here: #38 )

    NO! Only if it was the same default for the same debt using the same load dates.
