Are you prepared to put in a court claim if they don't play ball Sutton?

Yes I am. It won't cost me anything. I would need help filling out the form as I'm not sure what laws to use, if you catch my drift.

    Yes Court form EX160.

    Don't worry Sutton, :D

You have some good friends and knowledgable nice one's like NiD, Innocent, Cif, Noah..etc...they'll all help you of course.

If it should get to that stage then i'll help you with the Court business stuff.

    N1 Court Form....

From what to put on the 'Particulars of Claim' part, the laws relating to the type of claim you are issuing (ie defaults and S.10).

Further along the line, should it be, I can also help you with an Allocation Questionaire, Draft Directions and Court Bundle...oh and yeah....
a 'Wasted Costs Order' to claim your expenses and time back.

However, matey...it shouldn't get to that stage!

If you have a Jacamo account, can you open additional accounts with SimplyBe, JD Williams etc?

If you sign into the simply be or jd williams website it will let you sign in using your jacamo account detials ;)

However you can apply for seprate accounts if you want too.

The S.10 Notice should have been the FIRST thing to send before any other letters.

Until they get this....they are still processing your data. Data which may cause harm, detrimental, distress etc

No mate you can't issue s.10 first as this is a last resort when they have broken all rules. s.10 at outset would be void and ignored, lawfully so as well. Well you can issue it but they won't necessarily listen to it cos they can fob you off with a simple, prove it. Upon which letters 1, 2, 3 come into play so you may as well follow the order set - trust me lol

The account has to be in dispute prior to such action as well. stick to this thread mate: http://forums.moneysavingexpert.com/showthread.html?t=1674391

They do, after all, have a right to add data about you until you can prove they are wrong or until you send a s.10 which cannot be done unless you've proved to them that the debt doesn't exist/belong and it must also be in dispute (derogatory data should be removed at the dispute point).

Mate you would apply for enforcement order to remove data - they will abide long before court and also pay the fee for the MCOL. The actual N1 form is easy to complete and help is here: http://www.hmcourts-service.gov.uk/HMCSCourtFinder/GetForm.do?court_forms_id=338

The actual form itself is found here: http://www.hmcourts-service.gov.uk/courtfinder/forms/n1_0102.pdf

Don't worry, we'll get the data removed for you long before court action is necessary mate! They usually abide when the letters get stronger and more demanding. At the end of the day they have to adhere or they would lose their licences.... Plus could be a good excuse to utilise a few of the 'not so nice' letters in my inventory....

I'm confused. I applies for a 1st Account with First Direct 2 months ago. I got declined. I applied again a few days ago, phoned and they said 'I can't see any applications that where made today by you, but you applied 2 months ago and must wait 6 months.

I gathered Id be declined because of that, but I just got an email from them saying thanks for you application, we are sending an application to you with your details. Please sign and return it and considering further checks, we'll open your account for you.
