    The 28/30 day period they're arguing about is irrelevant as the iPad is faulty. Your rights under the 1979 sale of goods act overrides their store policy.

    You just need to stand there and repeat, 'under the sale of goods act, this iPad is faulty and therefore not fit for purpose or of satisfactory quality', until you get somewhere - or write to Philip Clarke if you don't. State that you're happy for them to repair your own model, but that having it replaced with a refurbished model is unacceptable and that you want either a refund or a replacement.

    You make it sound so easy!

    I tried to return DD's faulty top last month. I bought it in the half price kids clothing deal (£5 top bought for £2.50), returned it with my receipt 20 days after purchase, 1 wash after purchase. The 1 wash, following label instructions, meant half the print came off the transfer.

    Staff, and clothing dept manager, were adament I could not have a cash refund as I'd washed it. I could have an exchange, but only for £2.50, meaning that I would have to pay £2.50 extra to get a replacement of the top I'd bought.

    I quoted SOGA at them a few times - "but tesco policy states..." I asked if tesco policy overrode UK law. Response "we can only give you a clothing exchange to the value of £2.50"

    Just got a letter back from HO this morning (who interestingly "lost" my email last month, despite a return receipt coming through) whose written response agreed my statutory rights had not been given.

    £10 gift card - but really annoyed I had to write a letter to get my legal rights on a faulty product, especially having quoted them at staff. Makes me angry that so many customers who don't know SAD FART would have walked away and let Tesco get away with it.

    I got phones recently with a small DTD on them but one of the phones barely holds a charge and the quality of sound from the handset is dreadful. Can I take them back for an exchange to a similar value or can I only get a refund to the value minus DTD?

    I've never worried about returns before but this is the first faulty item I've had with a DTD so concerned that I'll be trouted.

    Caz I was totally trouted instore and by CS on telephone
    Received a £30 voucher in apology

    Crux of it is if it was massive dtd like with mine and they have written how much overcharge you got on the receipt it's unlikely
    If it just says overcharge you can plead ignorance and say you can't remember how much it was for- that's what I said in the 3rd store I tried , alternatively you could risk taking it back without a receipt. Last week i was stood at CS when a woman brought back some faulty scales and was allowed to swap them without a receipt

    Put my receipt with the 342 Herbal Essence in Price checker and got an email today saying Asda would have been £2.24 cheaper so got a voucher for that amount.

    I know it's not easy! :( I've stood there getting increasingly red in the face trying to return goods to various places, but you've got more chance of getting somewhere if you know your rights than if you don't. I got a very grudging, 'I suppose I'll exchange it just this once' at Dorothy Perkins recently with some faulty shoes.

    Nope, it just looks like a standard receipt as if I had gone through a checkout with groceries.

    I think after my and CS's calls to my local T's yesterday they will be keeping an eye out for me. :(

    Just so you know your rights, under the Sale of Goods Act, you can return an item within a reasonable time period if they are faulty etc.
    Tesco are Legally obliged to offer you a repair, replacement or refund (which one they choose is up to them, not you) in your case they are offering a replacement.
    They have no obligation to offer you a refund.
    You have every right to ask for an exchange for a better product and pay the difference, but they do not have to allow you to do so.
    As long as they offer you either an refund, repair, or replacement, they are not breaking any laws.

    Also, if you take your sister's back for a refund/exchange, remember she will need some alternative proof of purchase if anything goes wrong with her iPad.
  • where do i stand?

    I went to the stockport extra store earlier today. i noticed the bakugans on the shelf in a tub but there was no SEL. I buy these all the time and i know that they are around 3-5 pound so the fact that there was no SEL didnt bother me. I picked up various other toys and bits and bobs, paid at the self serve and to my horror it came to £163. I checked my receipt and noticed i had been charged £24.99 each for the backugans. I went to CS and she said i had clearly been over charged and called the manager. 2 managers arrived and they said that they cant dtd such a large amount and had the ring head office which is shut. I spent the best part of an hour arguing with them about dtd and they said the best they could do is to allow me to return them and give me a 25pound gift card for my trouble.
