First you need to establish at what point the PPI was added to the account.
If it was added at the application stage then you need to ask them to provide a copy of the application form/loan agreement showing you signed for the cover. If they cannot provide this they cannot prove you signed for it.
If these documents show you did not request cover at this stage then ....
There is a chance the cover was sold during the follow up call to complete the loan (these may have been done pre-FSA but it is rare). If this is the case ask for the call recording (they most certainly won't have it from that long ago). If the cover was added at this stage and they need to prove you agreed to it and the only way to do this in this situation is normally a call recording.
However there is also a chance that no advice was given to you regarding the cover and they are not responsible for the sale.0 -

This complaint point may be why you aren't getting anywhere.
The best thing to do is give specific reasons why your policy was mis sold to you.
Generic complaint points like saying they have been fined are easy to defend as they are non specific.
Especially when the company hasn't actually been fined (so I would check this too before using this as a complaint point) I don't know if Egg have been fined by the FSA btw...0 -
Egg has been fined! I claimed PPI back on my Egg credit card on this basis and on thge fact that I had claimed before. Got all my premiums and 8% interest within 4 weeks, am now complaining to the FOS because they won't consider repaying the interest that they then charged on the premiums which just increased my debt.

With the loan being take out so long ago you will not have any joy through the FOS route or LOL goodwill gesture route. You only course of action is to litigate.
With these policies you will have, by default, been mis-sold.
However, "the system" is set up to protect the lenders wherever possible and so you would have no choice but to seek the aid of a solicitor or of course do it yourself, if you know what the issues are and can argue them against a decent, if not top barrister.
Your best bet by far is to let a professional run your case for you, Providing there are no fees involved.I am a former Broker, former IFA and former compliance officer, for my sins.

I am having the same problem with Egg refunding the premiums on a Credit Card. Received a letter yesterday but no mention of refund or stating it was their final response. Should I go back and try again for the premiums.

I have just heard from the FOS that they are upholding my claim of misselling against Egg. I had taken out 2 cards with them back in 2000 and they then added the PPI. The thing with Egg was that they delayed in getting all the info to FOS so FOS just went ahead and made a decision re the complaint. Egg were saying that they sold me the PPI over the phone but then didn't provide proof of the conversation. In my case the fact that it was in 2000 didn't mean anything FOS still investigated for me. The strange thing is Egg held their hands up on one card before it was investigated by FOS but have delayed on the other one (maybe because there was more money on the other one).
I would write to them again, explain why you think it was misold etc and ask for their final respone and then go to Fos. Be prepared for a long wait though as mine has taken over a year to get to this stage:eek:. By the way, I've been waiting about 8 weeks for Egg to get back to me with a settlement, does anyone know how long they ususally take?0 -

They will acknowledge your complaint first then sometime later you will get a letter saying they will or won't refund the premiums. It took about a month for my claim to be sorted0 -

My settlement was refunded into my account by the time i received the letter from them0 -
I've asked for my PPI back on my Egg Loan and Egg Credit Card. They have both taken just over a week but both have said that because I did it online that I'm not getting anything back!0

I would write back and tell them, your not happy with this response, if its not a final one, tell them you want this reconsidered, sold online or not, you were mis sold with the reasons you gave on your letter.
