The system is easy to abuse if you have the know how and quite a lot of claimants out there are better versed in the rules than staff are. I guess it could be argued that they are just exercising their 'entitlement' to benefit but I dont agree with that arguement.

In no way am I saying that everyone who claims is abusing the system but it irks me that some people lambast the system as being too harsh when that isnt really true. Alot of people with mental health problems would benefit from being at work. I know that its good for me to be at work. Much better than being stuck in the house all the time.

true but putting everyone in the same boat does not mean it is equally right.

when i have a look at the ESA 50 forms it is not one of the easiest to fill in, especially their question regarding mental health are very badly turned . My CPN had a look and was surprised how badly worded the form was and their answer ie not very often /sometimes /often /usually , some of the question i was unable to answer them myself.

the problem lies that ATOS healthcare knows very little about the condition of the patient and based on their decision on a 15-30 minute meetings. when i asked them if they wanted me to send all my medical record to them their answer "well we don't really care but u can send it if u want too" that sounds scary, this is why they should based their decison alongside with the gp and consultant patient to makeit a lot meore effective.

then probably ti will be coem a lot less easier for this person to cheat their way through. When i was at the CAB , they batlanlty told me they are more interested on how i answer the question than actually my condition and this is why the problem lies.

I would be more concerned that your CPN was not already familiar with the form.

I do not for a minute believe that they used those words.

ATOS give their medical opinion based on your examination. A report from your GP and/ or specialist can be provided to (or requested by) the DWP DM, which will then be used in considering your application.

believe dmg when i first rang the jobcentre plus to make my ESA claim i ask them if i could enclosed all medical and psychiatric report as it explained a lot why i am not able to work. the women on the phone told me exactly that . i have enclosed it so they cant go back to me to say " i didn't know".

No dmg my CPN was aware of the form but when i ask him what he though about the ESA 50 form that 's what he told me. he helped me to fill it in alongside my other half

In all honesty it doesnt have much of a bearing on a claim. The only thing that makes a difference is a DS1500 (I think that is the name of the form) and no-one wants one of them.

I think you are confused. The DWP is not ATOS. You also contradict yourself on your comments about the CPN.
