I think this sounds like an adjudicators job TBH. I don't think any of us on here are really knowledgable enough to work in this area. We know a little bit about a lot...if you know what I mean:rotfl:

Hi Everyone, thanks for the replies. I will do a dsar for her about this. I have just checked her credit report on experian and there is nothing on there about this loan to this particular bank, plus as the bank have no records of my mum I really don't think this was a joint loan.

The debt collectors haven't written to my mum, they have written to my dad but at my mum's address. It was only when we called to say that he has never lived there that we were told it was actually a joint loan - but if it was why are they only writing to my dad

Anyway i'm going to call them now to give them my dad's real address :D and see what else I can find out.

Hope everyone is ok and starting to feel all Christmassy like I am :p

    hello everyone,
hope you're all well and fighting fit. You're post was lovely Di and even tho I'm a latecomer I'm including myself, lol.
Good luck with the problem Melora, not meaning to offend but would your father have forged your mother's name to get the loan. If so then this is surely fraud.

I think you should all apply for the FOS jobs, at least we would know that the claims would be stamped 'UPHELD, PAY UP SWIFTLY OR ELSE'

Hiya, don't worry no offence taken and yes he is the sort of person who would have done that. I'm going to try and get as much info and hopefully signed documentation proving it is her loan.

Of course since the bank had no record of my mum or the account number and sort code the debt collectors gave us then it's looking hopeful that this is an error on the debt collectors part (because my dad gave them our address) - or a DPA breach from the CSA (no other organisation has both my mum's address and dad's info linked and when I checked mums credit report she isn't financially liked to my dad either).
