    Was going to post up on this before, so this is a well delayed message from my hubby.

    Hubby noticed that over the past years things have not gone to well with various things.......sorry I cannot post it all up, as some of it is embarrassing.......and personal stuff, I'm sure you all understand, and your all so lovely and I know you will.:o

    I lost touch with quite a few mates, and have lost some really good pals through illnesses (do not want to depress anyone), but it knocked me right back in more ways than one, also close relatives, but it was one after the other sort of thing. I know many of us on here have been through it so will know how it feels.

    Anyway, since posting on here, my hubby would like to thank you all for being here for me and said I have opened up loads since being a poster on here, even though I joined up in 2007, it was not until last year I plucked up to start posting on here, even though many of you know I am already a Team member on another site, I was shy on there to start with as well....:o.

    My confidence was not there and as you all know I will try to answer the best I can, but can even get my words wrong and get all tongue tied in typing a times lol, and always happy for anyone to correct me, cos I don't want anyone to do the wrong thing cos of what I suggest, so I always ask that others post on their opinions as well, I think that is fair.

    So thank you everyone for being here for me, and to me your like family, I think the world of you all and would never be without you.:T:T:A

    Its down to you lot that I have opened up.
    We all get our ups and downs and that is life, but on this actual thread I think its lovely to discuss anything that is not related to PPI.

    I am so sorry for the ones that I used chat to on MSN, for some reason when I do try to go on there, it does something to my puter, strange and annoying, cos I miss our chats. Miss chatting to you all.

    Marshallka we have been having a great time with your above posts, please do post more lol :rotfl::rotfl:.

    Once everything is sorted, the debts paid, hubby back in work, if I have anything spare I am going to buy a new puter, nothing too expensive but one that allows me to go on MSN.........lol :D.

    Anyway..........hope you lot are well and getting all prepared for XMAS, not long now folks :j:j:j, perhaps Santa will come lol :xmastree::xmassign:.

    Hi Di.

    That was a lovely post. Am so glad you had opened up more and perhaps gained confidence. I miss our MSN as well Di we all had such a laugh on there.

    Really hope the rest of it all gets sorted for you and your family Di. It only takes small steps at a time to climb a mountain. xxxxx

  • Hi All, sorry I've been away for a while. I need your opinion and expert advice on this one please:

    My mum received a letter from a debt collectors today which was addressed to my dad. Now my mum and dad divorced in 1998 and we moved house in 2001 so he has never lived at my mums current address. He also doesn't know where she is living at the moment. At first we thought that this was a data protection breach on the part of the CSA and we were going to call them and give them hell. But then I thought I'd better call the debt collectors and check where they got my mum's address from. The debt collectors couldn't say where they got the address from but it emerged that they are chasing on behalf of a particular bank for a loan taken out in 1995. They said my mum is a joint holder of this loan even though they have never written to them. They said the loan defaulted around 1999 - 2000 and they had been chasing the debt at our previous address (where my dad used to live too) until June this year when they were given my mums address. They gave us the sort code and account number of the loan they were chasing and we called the bank becuase my mum doesn't remember taking out a joint loan with my dad ever.

    We called the bank and gave them the account number and sort code, the girl we were speaking to couldn't find anything with that so she searched for my mum using her name and previous address - still nothing.

    I'm thinking of doing a DSAR request but I'm not sure considering how long ago this is from. My mum did used to bank with this particular bank at around the time this loan was supposedly taken out but hasn't had any dealings with them since at least 2001 so she thinks that if this is a joint loan my dad has taken it out then he did it without her knowledge.

    What does everyone think?

    Hi Mel, hope your well hunni.;)

    I am no expert on this Mel but maybe someone else will have some answers on this one for you.

    The one thing that does come to mind is.....
    I am surprised they have held that data so long and still have record of this, normally by reading posts some cannot get anything from a SAR request, as they do not tend to hold the details as you know longer than 5/6 years.
    So in this case, if they do still have the info on this, maybe its well worth requesting for the SAR details, see what comes back.

    Bet that was a shock for your poor mum, bless.

    Saying that maybe in regards of owed debt, its a case that they do keep hold of the details, so something should come back if your mum requests for this.

    Hope you get this sorted out Mel, and come to the bottom of it, hopefully someone will have some answers on this one for you, but I was thinking about Dunstonh, maybe it will be worth you sending a pm.;)

    I take it your mum has never acknowledged this debt cause she does not know anything about it so how can they come after her when its over 6 years old and no paperwork in the meantime. I would contact the citizens advice. :confused:

    I agree with Marshallka, after 6 years the debt cannot be chased, there is a letter you can send about debt that is time barred and tells them to get lost politely!

    Debt companies buy these debts for just a few pounds and hope to get lucky!

    You have contacted me/us regarding the account with the above reference number, which you claim is owed by myself/ourselves.
    I/we would point out that under the Limitation Act 1980 Section 5 "an action founded on simple contract shall not be brought after the expiration of six years from the date on which the cause of action accrued".
    I/we would also point out that the OFT say under their Debt Collection Guidance on statute barred debt that "it is unfair to pursue the debt if the debtor has heard nothing from the creditor during the relevant limitation period".
    The last correspondence/payment/acknowledgement or payment of this debt was made over six years ago and no further acknowledgement or payment has been made since that time. Unless you can provide evidence of payment or written contact from me/us in the relevant period under Section 5 of the Limitation Act, I/we suggest that you are no longer able to take any court action against me/us to recover the alleged amount claimed.
    The OFT Debt Collection Guidance states further that "continuing to press for payment after a debtor has stated that they will not be paying a debt because it is statue barred could amount to harassment contrary to section 40 (1) of the Administration of Justice Act 1970".
    I/we await your written confirmation that no further contact will be made concerning the above account and confirmation that this matter is now closed.
