    Well I am on my soap box now so I will write to the FSA about this. Its funny I said this to my 17 year old daughter and her boyfriend and they went 'whats that mean' I am sure you will understand the soap box thing. you have been disadvantaged by this waiting Marshallka, if you had your payout before now you wouldnt be struggling.:D

    Can't remember how many businesses they did run or open and close now but more than a handful wasn't it?
    Di I posted an article I found on the web on the picture ppi thread about these companies blatenly going bust or whatever they call it and setting up again. If you read the article it clearly states that if prove can be found that they set up and went bust to avoid paying out on compo then the directors can be personally be accountable. the problem is how do we prove it? I am sure Picture have done this, they are at the same address, same telephone number but just a different name. it cannot be allowed to continue. If we borrowed money with no intention of paying it back the normal person would be in trouble so how can they get away with it?:D

    Mine is a complex case dialysis. It was a case that could not go against the broker as the broker not under jurisdiction so I put it against the lender being FP back in April, 2008.

    This got before an adjudicator when they were looking at FP complaints and then a day later thrown out as they thought my complaint was just about the settlement of the loan and not the unfair rebate of the PPI. I resubmitted and again an adjudicator and then thrown back to me as complaints about rebates are against insurers I later found out/

    This was when I got on my soapbox and said that surely someone is responsible for the rebate I received on settling early and they said they would make enquiries for me. It was then they wrote on my behalf to Lloyds of London and they told me that I should hear from them and I did. They wrote to say that they needed another 4 weeks and then I had to resubmit again to FOS.

    This went to FOS and then I spoke to another manager who told me that someone had looked at the case and they did not think I would win but they would try for me. I have sent in details of the rebate (which was totally unfair) but its a new thing and FOS have just 200 cases like this at the moment. They are looking into it but they have said they need time and its all to do with "wider implications" so all red tape. I have fought so hard for complaints like mine to be looked at through the fos and not given up so I am damned if I give up now. Last time I spoke to a manager was in July and I was told 3 to 4 months from then on so it will be soon and its not a clear cut case. These cases against the insurers are something new and they have to get all details of things (agency laws and who is responsible for who??? very confusing) before hitting the firms and also get permission from the FSA with wider implications I think.

    And BTW dialysis, we will always struggle as the loan we had with FP did more than just put us a few grand behind. Sometimes you get in to deep to get out and it just esculates and more to the point, motivation can take a dip for a while. We got out of our FP loan by adding it to the mortgage but now have a larger than the average mortgage so a vicious circle.

    Still I keep going cause you have to ey!!! Plenty are worse off than us.;) We need a finance overall I think as we cannot keep blaming the loan companies and banks for EVERY thing. I know they have not helped but we have at times spent beyond and means and not cut our garments according to our cloth.:o

    There is a name for companies like this, it's called something like "phoenix" something like that, but yes I know what you mean, its so damn annoying, I was taking this originally to a solicitor but withdrawn it, because I did not think I would get anywhere with it, after reading lots of stories on here......:eek:, yet they would have gone to the lender and not the broker, confusing is can be isn't it?:confused:

    This practice is perfectly legal in the "business" world.

    What is a phoenix company
    A phoenix company is where the assets of one Limited Company are moved to another legal entity. Often some or all of the directors remain the same and in some cases, the new company has the same or a similar name to the failed business. The phoenix company will operate in the same sphere as its predecessor. Are phoenix companies legal?
    It is perfectly legal to form a new company from the remnants of a failed company. A director of a failed company can become a director of a new company unless he or she:
    • is subject to a disqualification order or undertaking, or
    • is personally adjudged bankrupt, or
    • is subject to a bankruptcy restrictions order or undertaking.
    What can be done about those who abuse the system?The Insolvency Act 1986 gives the liquidator a number of powers to stop those who are abusing the system. These include allowing a liquidator to take recovery action where the failed company has entered into a sale at a lower than market value at a time when the company was unable to pay its debts. In addition, the Act makes it an offence for a director of a company which has gone into insolvent liquidation to be a director of a company with the same or a similar name, or concerned in its management, without leave of the court within 5 years after the winding up. A director who contravenes the Act may be made liable for the debts of the original company after he/she became director.

    Its sometimes more like "organised" crime really.

  • Hi Amersall, your very welcome. We all need a pat on the back sometimes;)

    I think these companies need to wake and pay up, its not fair making everyone wait the way they do. :mad: They need a good swift kick up the behind.
    I think I will take a good run up and do it on behalf of every one :laugh: :laugh: and I will make sure they cannot sit for ooh at least a month and so they will sort it all out. ....well we can but dream:)

    Mum said dad was quite calm today and this evening, he is obviously fed up but yes a move to the right place will be better cheers.:A
