    I reiterate, for the final time, either send me a copy of the default notice or remove the entry. As you say yourself, it is due to be removed in November anyway but out of principle I am taking this to the hilt and will succeed in my mission to prove your inability to perform the basic of functions lawfully and in line with regulated guidance; for clarity I have also complained to the ICO & FOS about Capital One.

    It's not due to drop off until May 2011

  • For the neutrals; the basis of the ICO complaint contains the details below. This shows how basic the actual complaint is; however don't be fooled - this will actually make the ICO read the supporting documents (basically the previous 3 letters and replies from Cap1) and see that Cap1 have blatantly ignored a lawful request for information (s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit)). As a result they will tell Cap1 off and this will help us to then take that to court - if necessary. All of which help prove they have acted unlawfully. :D

    Capital One registered a default against me and so I queried the legitimacy of the default notice by requesting proof of any notice of assignment and default issuance; i.e. a copy of the default notice.

    I reminded them of the law, in particular s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) which confirms I am entitled to request a copy of my default notice.

    I have requested this information on 3 separate occasions recently (excluding 3 previous ones)

    Each time Capital One ignore my request and respond with utter nonsense irrelevant to the case

    I require sight of alleged default notice to establish authenticity and validity prior to seeking legal enforcement for removal

    I have threatened Capital One with Criminal Procedure Rule 31.16 which is full disclosure of requested document but this seems extreme when they could simply send me a copy; after all under HMRC governance they are required to retain such documents for a period of 6 years
