Buying my stolen goods on ebay????

  • Sorry cant be doing with ploughing through 8 pages so don't know if this has been said but you would be breaking the law by buying something that you suspect is stolen even if it was stolen from yourself.

    Are you actually asking if you would be breaking the law in buying back what is rightfully your own property?

    It's precisely my point that Mandy's response might not have been thought through to the conclusion that a refund by that means would involve defrauding RM. It's the "victimless crime" syndrome that so many subscribe to these days, conveniently :mad:

    But this would not have been "victimless". She said she would try to get her payment refunded as there was no proof of delivery, then the seller would lose the money and even if it was her own phone there is no proof that the seller was the thief. More than likely it is not her phone.

    He could be an honest seller trying to earn a living and she plans to scam him.

    Gosh, I just came across this thread and can't believe how cynical we all are.

    I, for one, am hoping Mandy replies. I believed the story and to be honest, my curiosity would have gotten the better of me as well - It would be SO frustrating to think someone may be selling your stolen mobile and I wouldn't be able to let it go either. Though admittedly the odds are low..

    Mandy - please reply back and let us know what happened :)

  • Hello all,

    Yes well as I do have a busy job (two full day events on Thursday and Friday) and low and behold a social life (all be it a busy one this weekend), well done for correctly stating I had not been on here since Thursday afternoon.

    So, the phone is now at the police station as the IMEI underneath the battery had been defaced and some "software" had been used on it so screen - so it appeared all white when pressing the keys to reveal the IMEI. So until they come back to me, I'm afraid its not a simple case of saying yes it is mine!

    Also I simply mentioned that as in the case of paypal refunds, I had read up that the seller needs "proof of delivery", which the seller would not be able to prove in this instance. I never stated that I would be defrauding the seller (if it was in fact not my phone - i would of simply bought a replacement) and even if it was my phone, all I was concerned about was not letting this person profit from the sale. Even if it was an "honest" seller, why on earth would I not claim my money back for something that could be in fact MY OWN PROPERTY and was never their's to sell on and profit from. If they had bought MY phone and sold it on within a week, surely they wouldnt have paid "book price" for it and would themselves have been suspicious of the item. If the result was that I needed to claim my money back via Paypal I then would have sought further advice on exactly how to do this.

    As per my moral intentions, the fact that I wanted to catch someone selling stolen goods and was even willing to risk using my own money (which I couldnt be 100% sure I would get back), surely highlights my nature. Oh also I found an ipod last night, which has been promptly handed in to the police station today!

    Those that like to make nasty comments, then simply I think that highlights YOUR nature, more so than mine. You know what they say about bullies... It is people like those that put off people like me (who infrequently use these boards to simply ask for others thoughts or advice on given situations) from using them more frequently.

    Thanks for all those with genuine concern. I will try and let you know a final outcome but it may be a long winded affair. I'm not sure how long you get to make a paypal claim so I'm hoping the Police dont drag things out! Oh and also those that have blocked my brothers ebay account, well done as he obviously uses ebay lots (not) - a great use of your time and effort.
