    Put in a financial hardship claim 23/8/08. After some hiccups with bank not having received original letter, cocking-up handling my evidence internally from bank branch to their customer services dept. and me having to re-submit documentation, plus chasing bank and making sure bank got letter from Financial Ombudsman after 3 weeks, completing a financial statement and checking on progress every week, I finally got call yesterday morning with an offer of £1,228. Rather than wait for their offer letter of confirmation (post not as reliable these days) I arranged to go down to Customer Services office to sign acceptance form there. They are contracting in extra staff to cope with workload! Rather than wait up to their standard 14 days, I got them to pay into my account same day. 3 hours later they did! Happy customer at last!

    After sending details of financial hardship to YB, I today got a cheque for £1200!!! really happy I could have refused first offer but to be honest with the state of our banks I just grabbed it! Thanks Martin......Now for LTSB!:money:

    The story:
    I started this claim after everything was put on hold, dreading the outcome. It was only after reading the main site I read that is your financial situation is very poor (ie on benefits) then they are obliged to review your case. My situation was that i have had to give up full time employment to look after my partner who is disabled. They wrote back asking for a details on expendature etc and low and behold within a week I was sent an offer. I took the first offer as I honestly needed the cash!

    I also claimed back charges from my old TSB credit cards £379 and got that full ammount back too!!!!

    My husband claimed £1400 from Lloyds 2 years ago using the letters on this site. I had a problem opening our new joint account last July and since November had racked up £1200 in charges. The charges were making me over my limit leading to more charges!! I was worried about the situation in the high court and the merger with Lloyds but it took me about a month from start to finish after claiming under financial hardship as described on here.

    Don't give up, especially with things how they are. The banks don't deserve to get away with it!

  • After nearly 2 years since first making my claim, Abbey have just paid £638 into my account. I claimed it back using hardship circumstances. Its not the full £850, but I'm happy with the result.

  • Finally received a letter from Abbey today 25th October '08.
    I originally put my claim in in september '07, just to get it on their reords.
    Pushed forward with the 'Financial Hardship' reasons in early August.

    I wasn't very hopefull, so I will be accepting this offer.
    I can't thank all who use and work on this site enough, as I have £2000 mortgage arrears, and they are at the informing me they are applying for repossession stage so the money will be going straight to pay that. Ironically my mortgage is with Abbey aswell so they will be getting it back.

    I don't usually post I tend to just peruse, but wanted give all still waiting a little hope. :D I have learnt alot from here, also passed the knowledge to friends and family.

  • Sent in letter to Barclays requesting charges back due to financial hardship in July received a telephone call today offering me £650 refund.. The original amount I asked for was £1350 but the guy who I spoke to did point out that when the test case is over and if the courts rule in our favour we will get the difference refunded..
    I am in genuine financial hardship so accepted the offer so I now have a debt free bank account.. Thanks for all the info I have read on this site..Mucxh appreciated :)

    Having claimed back £1500 off Abbey last year and incurred more charges this year thought I'd give it another go and got a result another £521.17.

    I would just like to let you all know that I have managed to successfully reclaim my bank charges under the Financial Distress clause.

    The Abbey, after a real struggle and the help of the FOS have rolled over and paid my complete claim - £4.4k !!!

    The story: Unemployed and on benefits. Wife divorcing me... then not. Benefits reduced, went overdrawn. Abbeys charges ridiculous. One set of charges caused me to go overdrawn again. Viscious circle. Followed advice from this site and, after a few months of Q&A letters back and forth, they agreed it was exceptional circumstances and refunded all my charges. Now if Martin could just sort out my wife?
