  • I had successfully claimed some bank charges back in January 2006, I then reclaimed again later on in the year and was not successful, however, I have tried again this week under financial hardship and have got back all £1824 that I claimed. So it really does work...

    Originally claimed charges back in the beginning of 2007 before claims were put on hold and received over £1000. Since ran up more charges totalling £520 and sent letter last month claiming financial hardship due to self employment and reduced wages. Got letter last week offering good will gesture of £560.

    However the Halifax have imposed conditions - the money must first be used to bring my current account up to its overdraft limit (which it already is) and then the money must be used to clear arrears on any credit cards held with them. Only then will any remaining money be credited to my current account.

    Do not hesitate to claim back your bank charges if you feel you are suffering financial hardship.

    I have had a claim for reclaiming unfair bank charges from HALIFAX in for a good while, obviously this was on hold due to the court case, however I read on this site about the financial hardship ruling and felt it was worth a try. Due to my partner changing jobs and being off work on basic sick pay we have fallen behind with various bills, including my Halifax credit card - £200 in arrears (most of which are charges but thats another story!), anyway I rang the bank, I had just arranged a 6mth payment arrangement on my credit card with them, I explained all of the situation and within 2 weeks recieved a letter offering £997.00 goodwill payment, this is about two thirds of total amount but with our current situation is a godsend!
    One point to note is that part of the acceptance deal is that any credit card, loan and account arrears are cleared, so £200 will go to credit card but this helps us.
    Having read other peoples situations I feel it really does depend on who you speak to as to the outcome - our situation is no where near as bad as some others and I urge everyone who is struggling to persist with this new ruling - it can work for you! THANKS!!

    I refused and threatened to take Court action(used the standard letter)

    They caved in and payed up in full!!!!!!!!!!

    sorry guys i'm guilty of double posting but didnt know this thread existed, anyway to the matter in hand, i started reclaiming process around april and recieved the usual banks are in appeal process letters, then the financial statement which was promptly filled in and returned (recorded delivery) and i recieved a letter yesterday saying due to my financial curcumstances they will pay the above amount. absolutely thrilled to say the least, christmas is sorted and i now have no financial worries, thank you so much everyone for your invaluable advice. and to anyone going through the process keep the faith :) xxx

    Story:

    Well for starters thank you to this brilliant site because without it I would not have known you could claim under financial hardship. Put in a letter to the bank about 2 months ago and after hounding them every day I eventually got an offer last week for two pounds less than I asked for. But will be accepting this none the less!

    I want to wish everyone the best of luck in their battles, it is really horrible what the banks are putting us through, I have already changed to Alliance and Leicester who dont charge anymore.

    Started this with the templates from Martins site in April last year claiming as above for over charges. This was replied to with a holding letter. Shortly after this the test cases began so my claim was put on hold like many others until the test cases completed. I was happy enough with this until I read about some successes due to financial harship. I wrote a letter on 21/8/08 expalining my situation financially and though and behold I got a reply exactly a month later with the above offer as goodwill gesture. I was astounded by the speed of the offer and the amount, the additional amount to bring my account within my overdraft limit. I have accepted and they are to credit my current account within 14 days from 22/09/08, the date they got my reply as per phone call today.   • I first started the reclaiming process in July 2007, my charges in total came to £6,100 but I asked for £5,000 (to stay within the small claims court remit) and was told from HBOS in Aug 07 that they had filed my complaint but they were waiting for the test case... I knew nothing about the financial difficulties loop at this point.
    In Aug 2008 I saw Martin on GMTV explaining how to use the financial difficulties clause and I decided it applied to me...So I started the reclaiming process again.
    On Sept 10th after many letters and a threat of court action HBOS finally offered me a satisfying £6,493... I accepted.
    My advice is simply to use the letters off this website, if Martin is on TV talking about this subject then tune in and don't give up...HBOS are very good at ignoring your letters, so always send them recorded delivery then you can check they have been received.
    If the financial difficulties applies to you then use it...it has worked for me.:j :T :D

    Abbey have recently agreed to pay me back more than i asked for, i sent them an income and expenditure list on 27 august 2008,to prove that i was in financial hardship, they wrote back on 26 sept 2008 and agreed to pay me back the above amount.:rotfl:
  • Hey all

    Have just recieved a letter from HBOS today saying i qualify under the financial hardship rules, and they are refunding me £1040 within 14 days. This is but £10 shy of what i asked for and includes interest!!
