ratty, I'm sure the last thing your DH needs is another battle, but surely if he makes a formal complaint about nothing else, that last action by the solicitor is surely it!Signature removed for peace of mind0

Strewth - you couldn't make it up, could you !
1) Has your OH asked for copies of all correspodence between Phoenix Life and the solicitor? It would keep things nice and tidy for the future. I'm sure he has, but just in case.......
2) I thought the LA would start to behave and do things properly, pity they've spent so much time faffing about.
3) Once again, well done to your OH......................I'm smiling because I have no idea what's going on ...:)

Errata - if I wrote all of this down in scripted form and sent it to every television company or radio broadcaster globally they would all turn it down for being unbelievable I'm sure!
Yes, DH has asked for a copy of the letter the solicitor sent to Phoenix Life. On reflection I think he phrased it slightly more as a 'demand' but she got the ideaHe did also have a little 'vent' at Phoenix Life!
Fingers crossed the LA continue to see things the way common sense says they should.Sealed Pot #418 ('09 £414.12) ('10 £550.90) ('11 £440.60)0 -
Ratty, it would make an excellent anonymous case study for Age Concern information officers training packs !.................

it's another thing to be clearing up after a useless solicitor.
DON'T TALK TO ME ABOUT USELESS SOLICITORS!!!
Sorry for shouting, but we have been dealing with one of those since my parents died in summer 2007 roughly 6 weeks apart. It seems to me that some solicitors are totally ignorant of the Law.And still expect to be paid.
Our problems have been very different to yours, but if you're interested you can find my (very long) thread here. (You will find some friendly faces you will recognise over there too!)
I owe an update (things have moved recently) but not had quite enough energy yet. Hopefully later this week if Life doesn't happen again.
At least we have a decent solicitor now, who is making progress and helping sort the mess out. A STEP Practitioner. But it's still taking forever - gawd, the Law grinds exceedingly slow!No offence meant to our new Sol, who is gradually fighting through all the carp.
Your OH is doing a grand job, for which he will get little thanks. Especially from she whose name should not be mentioned!I am sure the Lady is watching over him from above, and is grateful. We go to make our Wills next week, this thread has given me a lot to think on. Thank you, and thanks to your OH for battling on.
Very best wishes,
Maggie0 -
Errata - it would probably make them think twice about taking up training!
ukmaggie45 - I'm working my way through your thread now. Oh. My. Word. What a mess. However have you stayed sane?

Just discovered this thread. What is a DH please. This DH is mentioned in the first post and without knowing what it means the thread is difficult to follow. If it's somekind of textspeak then it needs to be explained.
Moneysaving tip. Never, ever, at anytime, let anyone put you down as a next of kin. You can get stung for hospital bills, nursing home fees, bill payments, etc etc, always let other family members get named.0 -

DH is usually Dear Husband, and there's also OH - Other Half. DS is Dear Son, DD is Dear Daughter, SiL or similar is Son in Law, and so on.0 -
The solicitor can consider herself out of a job.[FONT="]Thank you localhero for explaining so clearly about 'unjust enrichment'. That is exactly the information DH needs. Brilliant! Is daughter worth suing? Quite possibly... I have looked on the STEP website and found several members nearby.
DH does not have 100% confidence in this solicitor, he hasn't signed anything or instructed her to do anything. He's found out today that not only has the solicitor written to the bank (she was asked not to, I wrote about this yesterday) but also to the other firm of solicitors which again she was asked not to as DH is dealing with it (going there tomorrow).
This solicitor literally did nothing (as should be) until she received word there is this 'unknown' amount of money being held. Now she's trying to pursuade DH not to be executor and doing work DH has already done/is in the process of doing. DH is of the opinion that the amount of money to come could be substantial, he can't see this gentleman leaving his widow short, but he could be wrong. He's also trying to trace another policy that may have lapsed that was supposed to cover the funeral.

LOL, thank you for your humour.
I would appreciate a serious answer because it makes it difficult for a newcomer to follow the thread without knowing.0
