    oh boozercruzer the next time(hopefully not though lol) orange start their carp with me i am definitely gonna take it further. s.o.b's have had their last penny from me. congratulations on your award you deserve it and maybe their is hope for the rest of us :T:T:T:T:T

    Hi Guys. I have had further E. Mail corrospondence with Orange today as follows..................................................................

    ORANGE..........Thank you for your correspondence dated 19th May 2009, received by me today, the contents of which are noted.

    I confirm that I will today arrange for a cheque to be drawn in the sum of £135.00 in full and final settlement of your claim, without admission of liability. This should be with you within the next 7-10 days.

    In light of the agreed settlement, I would be grateful if you could contact the Court at your earliest convenience in order to withdraw your claim in order to save both parties further costs in this matter.

    Thank you for your E. Mail, I am much obliged.

    However, with respect, I am not prepared to contact the Court until I receive your cheque.

    As I understand Court Procedure, I will not incur further costs unless I wish to continue my claim and pay £50 to request a hearing.

    Obviously at this moment in time I have no intention of doing this.

    What I cannot understand is that when Laura Boehme of Orange customer care contacted me by telephone some weeks ago she offered £50, which I refused.
    She advised me that if I accepted and I gave bank details then that amount would be paid into my bank account that day.

    I have given you my bank details in the hope that both of us could draw a line under this problem as soon as possible.

    I do hope that you can please either try that route, or have the cheque drawn up sooner than you have advised me.

    I have arranged for a CHAPS payment to be made direct to your bank account tomorrow morning, this should show in your bank account by 6pm tomorrow evening. I hope this course of action is satisfactory, if you could confirm that you are happy with this, I would be grateful.

    I would also be grateful therefore if you could arrange to withdraw your claim at your earliest convenience.

    ME................Hello again,
    Yes I am very happy with this course of action. I will check my Bank Account online tomorrow evening and provided the agreed amount has reached my account then I will contact the Court first thing on Friday morning (22nd May 2009) and withdraw my claim.

    My only observation now is that had Orange shown your level of support in sorting out shall we say this 'misunderstanding' then this issue would have been settled two years ago, and I could have avoided the upset and distress that this problem has caused my Wife and I.

    County court judges would not consider BC to be foolish with his claim, they do understand the frustrations of the man in the street and claims such as this and are generally supportive, I think it is the monetry value which makes you negative? but at the end of the day, was it not this claim which made them examine their own files where clearly prior to the claim and despite correspondence from BC to them and the Debt collecting agency, nobody had been listening.

    And your experience of County Court Judges is what?

    Oh and just for the record, you can withdraw a claim before receiving a cheque. If they don't pay up it is a breach of the settlement agreement.

    Doubtless there are some guys in OUK having a very good laugh about your actions.

    Do you not think that BC did attempt to escalate this ? and how much time do you spend receiving correspondence and contact from Debt collectors before you take action?

    To have these type of leeches chipping away at you with letters, but yet not taking court action against you in order that you can defend yourself is very wearing, just threats of action and the continual letters which you say ignore is very difficult, the letters do need responding too, as if or when any action is taken against you, questions will be asked as to why you did not reply.

    Eventually as in BC case he clearly felt enough was enough and I can understand the frustration in taking an action designed to attract their attention as clearly responding to them in the past with the approach of I owe you nothing has not worked, therefore a need to respond and counter claim to ensure the other party actually examines their case as they did in this situation which led to a settlement which gave some satifaction to BC who had been on the receiving end of a faceless and clearly unstoppable system.

    The financial claim and the monetry values and how these were reached, really has no bearing and were questionable to say the least, however, it was the counter claim and positive action which stopped Orange and made them examine the facts and finally stop their own system? otherwise this could have rumbled on and on.

    I thought the idea of this whole thread was to take orange to court and not settle out of it. Seeing as you've settled or planning on it for no-where near what you were looking for, am I missing something here or is it all a little disappointing...
