    And I think you will find that the police would rather stop someone who is just under the limit (and can be checked again), than be called to a fatal accident.

    This is all very well but I really can't see the Police rushing to do anything. In any event, they would need to show reasonable cause to stop the driver anyway. Unfortunately, as I understand it, the Police cannot just breath-test anyone leaving a pub.

    IIRC the Police can do a breath test at any time they suspect someone has been drinking before getting into the car, be it acting on information received (tip off from concerned MOP or even the landlord of the pub for example), or observations (driving erratically/unusually slowly etc).
    A tip off from a concerned member of the public would almost certainly be considered a valid reason to stop a driver.

    They can also do a breath test if they've pulled you over for any other reason at all, and suspect you might have been drinking - so if you've got a dodgy rear light and they pull you for it and catch a whiff of booze they can do a test, likewise it's fairly common for them to do a breath test on drivers after any accidents they attend.

    Indeed, I beleive technically they can do a breath test the moment you get open the car door and if found over the limit charge you with being drunk in charge (I think is the term), which is a lower charge than driving and just basically requires you to be over the limit, whilst in the vehicle with the keys.

    Trust me they can breathalyse anyone they wish whenever they wish :)

    Yea exactly , my uncle had to wait an hour and a half for another unit to bring a breathalyzer when he was stopped last week. The officer was saying stuff like " Oh we will find out , i know youve been drinking"

    My uncle was patient and smiled at the smug officer when he finally blew into it and it came up ZERO.

    Bet that copper was a bit "!!!!ed" after that.

    Anyway ,with regards to the OP , report them ASAP , dont be silent as it just increases the chances of an idiot killing someone.
