I have to admit I'm not 100% in terms of business assets, perhaps someone else will come along to answer that one. Welcome to the Self Managed Debt Plan:beer:.
Your figures are very similar too ours and lke you we didn't have any missed payments as Mr Credit Card was used to live on:o.
With regards to your business account I would think (I'm assuming he operates as a non-limited company?) your bank would try to use this account to make payment to your debts, however legally I have no idea if they can - maybe not if the debts are joint.
Maybe if you start a new post on this board somebody with better knowledge than me could answer you. I'm still very much on a learning curve:p.
Good luck with everything and be sure to keep us all updated as I find it really helps me stay focused.
Also, have a read about obtaining CCA (for non-enforceable agreements) and reclaming charges and PPI insurance.

Sorry about the delay in replying - things have been a bit manic here with the kids being back to school etc.
Today I have rec'ed another letter (snotty at that) from Capital One saying that "I can be assured that they can request these documents without a court order"!!!
Have you had any further contact with them. They are refusing to accept my offer (for OH account - my account they seem to be handling differently) and freeze interest:mad:.
Need to go an research a reply to them - complete and utter !!!!!holes:p0 -

Just looking for a bit of advice. Skycard have just spoken to me and have declined my pro-rata offered (worked out by CCCS) saying that if I am doing a self-managed plan that I need to make a repayment per month of a least 1% of the outstanding balance. My figure is below this, however they say that they may accept less than the 1% if CCCS contact them direct of my behalf!
Any ideas how I should reply to this? I have told the guy I'm not in a position to offer a higher payment at present. Do I really need to use CCCS or does anyone have ideas how I could handle this? Could I just send a letter about not having to use a debt charity etc etc?

Gar, honestly I haven't won the lottery! (I wish) Mostly paying the council tax arrears but it feels good to get started - even with the giant pile of poo that landed.
I have had 2 more letters one saying prove the arrears - going to think about whether I am prepared to send it. The other one, for a payday loan, says my token offer is not enough. I will write back and tell them it will have to be as they are non-priority.
BJ - I thought there was some rule that they were meant to treat all debtors fairly, and saying that they will accept less if... surely means that they are treating you unfairly?Ebay challenge 2010 - £525

Just looking for a bit of advice.
Skycard are being complete twits and constantly phone me saying they will not accept my offer of pro-rata payment as it is less than 1%, however they would if I went to CCCS or the like.
I have told them that I will not be going to CCCS as most other creditors have accepted our plan, however they have now threaten door step collection:mad:.
I spoke with a rude jumped up little girl today who just kept repeating that they will not accept my payment and that 'we were going round in circles' so there was nothing left to say and put the phone down:mad:. Cheeky biatch!
Anyone any ideas/templates of a letter that I could send to Skycard to try and get this sorted?

It is illegal for them to have a door step collection without you agreeing for an appointment. If someone shows up, tell them that and that you do not wish to make one. Have a look at this link for more info:

Yeah they are being annoying to me too, all my creditors keep ringing, so I have put the phone on silent as it keeps stressing me out, they keep ringing and saying the same things over and over.
Capital One - They won't accept the reduced payment unless I send them the documents they want, which I won't do, so today I received a letter to say if I don't make a payment of £75 or so, then they will register a default on my credit file, may pass my debt to a dca or take me to court.
What should I do, just hold me ground, keep making payments and ignore them? I assume if they pass it on to a dca then the dca will accept lower payments, do you think?
They are refusing and still adding charges and interest, so just waiting it out I guess.
Barclaycard - They keep putting me on this automatic dialer thing which is the reason my phone is on silent as it was driving me up the wall. I sent them a letter to say please reconsider the lower payment and stop ringing me but they still ring! I spoke to someone this morning who said my payment of £42.42 isn't enough I have to pay £50 and I need to send them official cccs paperwork before they can accept. Is that for real? What can they do next? I guess I am more afraid because I don't have cccs backing me up this time, so I feel like they can do things, I am worried about my house etc.
HSBC - also won't accept my payments, just sending letters asking for payments, received one phone call, pretty pleasant guy but they couldn't accept the lower payment.
So none of my creditors have accepted, not really sure what else to do?

Kat keep making the pro-rata payments you have offered. If things do escalate to court you can show that you have acted in good faith and have made payments as offered. I had a similar experience with AMEX 2+ years ago who refused payments offered and put my case straight into court and wanted the whole amount - what they got was an order for payment based on the figure I had offered them and was already paying them. The District Judge commented that AMEX had wasted his and the courts time as I could clearly prove offer of payment, payments made and could prove agreements with other creditors............he still granted the court order though! At least the interest got frozen!
Barclaycard are hard to deal with you just have to be persistent and thick skinned. I've no experience with HSBC.

Hi all,
I am quite behind with the letters at the moment but will try to catch up everything this weekend. Some of them are just confirming arrangements, a few others are being silly!
I have worked out that this month we paid £870.60 towards our debts. I'm not sure how much longer we will be able to keep this up - hopefully OH will find work soon.
