Barclaycard - They keep putting me on this automatic dialer thing which is the reason my phone is on silent as it was driving me up the wall. I sent them a letter to say please reconsider the lower payment and stop ringing me but they still ring! I spoke to someone this morning who said my payment of £42.42 isn't enough I have to pay £50 and I need to send them official cccs paperwork before they can accept. Is that for real? What can they do next? I guess I am more afraid because I don't have cccs backing me up this time, so I feel like they can do things, I am worried about my house etc.
HSBC - also won't accept my payments, just sending letters asking for payments, received one phone call, pretty pleasant guy but they couldn't accept the lower payment.
So none of my creditors have accepted, not really sure what else to do?

Keep your chin up - the story was the same for many of us when the process started proper. Persevere - write to those stating you must use CCCS or similar, stating that you are entitled to negotiate directly with them and that you have prepared your budget and offers of payment under the advice and direction of CCCS and National Debtline. I did an online debt management query thing with CCCS which generated a reference number which I use on my letters, and likewise when I phoned National Debtline for advice they also gave me a reference number which I quote. After a while HBOS (who were insisting I used CCCS or similar) stopped writing that rubbish to me, and although they haven't "accepted" my payments - I have since put the account into dispute as they haven't been able to provide CCA - and have sent a letter which hints they won't be able to either:D.

Was contacted yesterday by a commercial DM company and they wanted £350 per month for the first to months to manage the 'account' - thought to myself, have I got mug tattoed on my forehead!! :rolleyes:
Anyway decided to take the bull by the horns and manage my DMP myself.
I've sent off ccas to all my creditors in August, one actually wrote back and said that they didn't have a copy of my cca but I should use their current terms - I think not.
Wrote to all my creditors in August offering token payments for three months until I get myself sorted and get bits a bobs reduced and cancelled so that I know exactly how much I'll have to repay them.
One has replied stating that I must give them my account number with cccs and the date of my interview - I have never mentioned cccs in my letter.
The others have ignored my letters and one has sent me three letters in September stating that I'm ignoring them. At the end of September I sent copies of all my previous correspondence out again to my creditors, and I intend to make the token payments tonight.
I assume that this practice of ignoring letters sent by debtors is common.
Any tips would be greatly appreciated.
By the way, I'm totally responsible for my debts, been really stupid and had my head in the sand for so many years it's unbelieveable. I do intend to pay my debts in full, it will take me years but I'll do it.

Its good to make contact with CCCS and National Debtline for advice - and their template letters are great. Also, when you contact both you will be given a reference which can give your letters some clout. I never say I'm in a DMP with CCCS but I quote the references and state I have taken advice and calculated my reduced payment offers in conjunction with the advice of National Debtline and CCCS.
I assume you will write back to the creditor who have stated they cannot provide the CCA to let them know the account is in default now, until such times as they CAN provide a CCA - also that they consider reducing the balance to zero and closing their file.

Hi All
Got the agreement letter from the Commerical DM company, only way I could get them off the phone. My mum indoctortranated good manners into us and I just can't put the phone down on someone.
Anyway, going to write to Commerical DM company and let them know that I'm going to manage the DMP myself.
I'll get onto CCCS and get myself a reference number and send out the letters again, that way they can't say that I'm ignoring them.

Well done, you don't need to write to them explaining you intend to do this yourself - they are likely to write back saying that you will be unable to have charges and interest frozen etc etc, however many of us have succeeded. If I was you I would simply write to them stating that you no longer wish to enter into an agreement with them, and that you request they do not continue to correspond with them.

not been around for a while but though I'd check in with the "story so far"...
Posted our letters & pro rata cheques around 24th september, then went on holiday for a week!
Came back to a few statements, £12 fee notifications for late payment etc, but most of these have crossed in the post.
MBNA & Virgin CC (same company I know), have sent 2 letters, acknowledging our budget planner, and asking us to give them a call to discuss the details, depsite our letter clearly saying that for the sake of clarity and to avoid misunderstandings in the future, all communication should be by letter only.
So, going to write back and ask what part of "no phone calls don't you understand!" - only joking, I'll be nice to them really!
Other than that, no-one else has replied, but 8 out of 10 cheque have been cashed!0 -

Well, again things have moved on, but only slightly!
Only 1 of the 10 creditors have not yet cashed the cheques that were stapled to our letters, so maybe that went to the wrong department / office.
Interestingly, Next accepted our very small payment of £6 a month (debt is £2000) with no questions at all. They did however ask us to sign a letter agreeing to pay the £6 a month.
They also (interestingly) asked us to sign a new Credit Agreement. Now having read so much on here about unenforcable debts due to wrong/no CCA's I had a thought - are they asking us to sign one now on the basis that they don't have one in place already?
So I've sent the £6 payment agreement back, but said I was wary about signing another Credit Agreement as we already have one, and for the sake of clarity, could they send us a copy of the original signed Credit Agreement.
I wonder if anyone knows what will happen if they can't provide one? I haven't "disputed" the account, and I was very nice & polite about it, but if they can't provide one then what do we do next?!
MBNA are ringing, and writing asking us to ring, so I'm just going to write back saying "no - just put your comments in writing" - it isn't hard, is it?!
Barclaycard said quite simply, "no, we're not accepting your offer of repayment. Pay more...". They've also picked up on the balance transfer & credit card cheque I wrote about a month before I wrote then THE letter. I've told them that the funds were used to pay off secured credit, which free'd up income to pay them. The alternative was we paid the secured credit first, which meant they wouldn't have got anything... Not sure if that was the right thing to do, but its too late now.
The fact is we've been living off credit now for far too long, hoping "things would get better". We finally accepted they wouldn't so we did the decent thing and made everyone a realistic (if a bit rubbish) offer of payment.
I can honestly say now that I am no longer scared when the postman comes - when I open a letter saying we're late in paying, or they've charged us £12 for a missed payment, I'm not that bothered any more. I'm not proud of what we've done, or where we are, but we're there due to circumstance & fate.
We weren't overcommited for the income we had, but that has gone so things have to change. I'm sleeping soundly in my bed for the first time in months, and it is in no small part due to the help. advice & support of all you people out there in t'internetland. You may not have even replied to my posts, but the fact that you're out there offering advice to others in the same situation means so much.
So - thanks for listening, and keep smiling - life's too short...

Now all of our £1 cheques did eventually get cashed - some later than others. I wouldn't chase it up - did you send them all recorded delivery anyway?
Send MBNA the harrassment by telephone letter. If you have online access to this account go into your personal details and delete your telephone numbers - works a treat!:D
Next also didn't put up a fight with us although we were offering £6.92 per week on a debt of £1200. Recently, they sent us a letter stating "further to our recent conversation, as agreed your monthly payment is reduced to £6". I didn't have any conversation, and funnily enough they also included a credit agreement for my signature to accept this agreement:rolleyes:. Now I have CCA'd them and they sent back an illegible document. I should have stopped paying them - but stupidly haven't (don't know why - I've had the cahonies to do it with bigger muppets e.g. Barclaycard:rotfl::rotfl:). I wrote back (but then if you've read my thread you know I live to write letters:rotfl::rotfl::rotfl:) stating that I didn't have any such conversation and that I am concerned if they are discussing my account with someone else - and that I would not be returning a consumer credit agreement, as I am not currently seeking credit from them:D.
Next are good, make the agreement payment they will stop interest and charges without a fight and review you 6 monthly. DON'T SEND BACK THE AGREEMENT (I know you know that - but I like the drama:eek:). I assume you sent the £1 fee when politely asking for the existing agreement - if not they don't have to honour this request so you might want to do it "officially";).
As for Barclaycard - everyone on here will tell you they never accept anything other than the minimum payment. I carried on paying what I could afford until they were unable to provide our CCA. I have since stopped payments - they continue to write me lengthly legalese letters and whop charges on. I have a complaint in progress with the Financial Ombudsman:D.
