Well done you!
Letter writing can be quite cathartic, you are well on your way with some of these. Stick at it, some may put up a fight. Think how satisfying it will be when you get a result!;)
I'll have a read and see if I can find out the exact date. If not, the best idea would be to PM Fermi - he/she seems to be a bit of an expert with CCA's! You might want to google CAG - consumer advice group as they have a couple of experts on there too.
Well done on making a start on your list, off to chill the wine for tonight_party_LBM 30/6/9 Unsecured debts [STRIKE]£25,323.48[/STRIKE] £0 :T Debt free

Good luck everyone,
oh yeah, what does CCA stand for?

another thing, is it ok to claim for bank charges from a company who has agreed or not agreed a dmp with you? I am nervous that they will not commit to the dmp if I try to claim money from them.
Hi Kat
I only sent letters of regarding my own self-admin DMP within the last week and haven't heard anything1 Gargraves (another poster) has been a great help to me and answered loads of my questions. It was also mentioned that you may not hear anything so just set up a Standing Order for the pro-rata amount to offered to pay and start paying your creditors.
CCA - Consumer Credit Agreement (I think). Anyhow, if you have taken out a credit agreement pre 2006 (I'm looking for the date to be confirmed though) and the company cannot provide you with a credit agreement they cannot enforce the debt. I still learning about this so take what I say with a pinch of salt:rotfl:.
I am currently reclaiming PPI from creditors that I have included in my DMP and I am going to hit them for bank charges as well.
HTH and good luck

Hi Kat
Have a look at this one:

I am only now starting to look at this.
Hope this helps.

Just another quick update:p. This helps me stay focused:o.
Have started to get calls from 3 creditors so I am going to post letters (all printed and ready to go) on Monday recorded delivery requesting all communication to be done via post.
I have written and printed 8 letters for creditors I think we can request our CCA from and hopefully find they don't have relevant documents so we can save and make F&F's.
Paid nearly all the creditors their pro-rata amount - need to get some details for a few though.
I have a new revised list now to tackle tomorrow but in reality I will probably not look at it until Monday:o.
Spends today were quite high as I had ebay goods to post and I bought the kids a treat - small choco bar each - spoilt brats:rotfl:. Bless them though they really aren't getting stuff or treated like they used to and aren't complaining about it.
Have a nice weekend all:j0 -

We have a barclaycard cc and so far they are ignoring our DMP offer:mad:. I'm sure we will shortly be following you to Mercers. I have to say there isn't an awful lot positive said about Mercers as they appear to be Barclays in-house debt collectors:rolleyes:. Do a search and you will see what I mean!
Are you talking about reclaiming bank charges under the hardship clause? If so it can be difficult to prove hardship and the bank are looking for you to have arrears in your priority debts before they acknowledge hardship in many cases.
We recently had a bank charges hardship offer but not from Barclays - HBoS.:D
I was looking at another thread about claiming credit card charges and was under the impression I could try and re-claim. It was MBNA who really peeved me off. They reduced my credit limit when I called them to say I could not pay, charged me £12 default for cancelling DD, charged me another £12 for late payment, added interest, this caused me to go over the new lower limit so they charged me £12 and charged me £12 again for late payment so £48 plus interest in one month. I'm actually getting further into debt each month so if this continues, I will never pay anything off ever!! Mercers have left 2 messages on answering machine to call them. Cannot wait for tomorrow when the phone won't stop!!0 -
You can claim the credit card charges, there is a specific thread if you go into bank charges there is a separate group for reclaiming cc charges. There are template letters adapted. The OFT aren't taking action against those who charge £12 or less, but there have been successes. Give it a read.:)LBM 30/6/9 Unsecured debts [STRIKE]£25,323.48[/STRIKE] £0 :T Debt free

Meant to say working mum, don't know if it helps but when writing to my creditors I always point out that my reduced payment is less than the interest charged each month and therefore the actual debt will never be repaid. However, if they freeze interest and charges my debt would be repaid in x months, because my monthly payments would reduce the actual balance owed.
I wrote this to Barclaycard, however they would appear to be ignoring me?LBM 30/6/9 Unsecured debts [STRIKE]£25,323.48[/STRIKE] £0 :T Debt free
