sparklewing wrote:A couple of months ago they tried to make me pay back the whole overdraft which I was unable to do due to being off work sick etc so they agreed to accept a monthly payment of £20.
Anyway I've had this account for years and know for a fact that for 2 years of it was being charged £90 a month in charges for being continually over my overdraft. On top of this there has been loads of other months where I've been charged £75 or £90.
At a rough guesstimate(don't have my statements) I reckon over the past 6 years I've been charged at least 3000 probably more.
Should I try to claim them back? I'm scared they will refuse and then try to make me cough up the whole overdraft which I can't do.
I have an account with another bank which all my bills etc come out of so don't care if TSB shut my account just scared of the bailiffs coming or something.
Well, they certainly will refuse to pay you back without hassle, that's for sure.
But if your o/d is £1500 and they've charged you £3000, what's the problem? Once you have your money back, you pay the o/d off!
If they try to put pressure on you to close your account, you tell them the amount is in dispute and will not pay off your o/d until dispute has been resolved. Meanwhile you keep on paying your £20 a month.0 -
hostie wrote:Thanks Bookworm for helping us all. I will definately donate a portion of my charges to the Consumer Action Group if I am successful and I hope that others here will to. What a useful site! Anyway as I am not able to post on it, I have another question here.
I am nearly at the stage where I have to take the bank to court. I was due to post the letter giving them two weeks on the 22nd June but they phoned and said that they would get back to me when they have the information on my account so I am holding off in case there is an amicable offer first.
My question is when I have to take them to court do I do it through the English court system or the Scottish one? I live in England but my branch is in Scotland (I am with the Royal Bank of Scotland).
Thanks a million for helping us all.
You still haven't said why you can't post on CAG?
If you live in England, and you can find an English address to address your claim, you can claim under English system.
You could try this:
Group Litigation, RBS
1 Princes Street
London

Hi, its chrissy, I have had a letter back from Lloyds basically telling me that I knew of the charges and therefore are not paying me back the 900.00 charges, so whats next please lol Also Abbey have not sent me all my statements and the 40 days are up, I ve only had a couple back.
Sorry not caught up yet but I am having lots of stress with LEA and court at the moment as I withdrew my kids from school because it was damaging them by being taught incorrectly for thier special needs APD SID DX etc.:)0 -
i am considering claiming back charges from both halifax bank ( current acc now closed - due to charges- i never paid them so was closed...do i need to pay off 1st - does it matter its closed?)
also halifax visa capital one visa, and the dreaded barclaycard..who am in huge muddle with due to charges making me over limit.
i have no idea what my 1st step should be or how to word any letters. i wish there were templates!
i think i'm going to start with halifax visa and barclaycard visa as capital one stopped the charges when i got with a dmc.
i am due to pay off the remaining 200 pounds i owe (my original credit limit!) in 2 weeks time. will this matter?
any help greatfully recieved -

There are templates at https://www.consumeractiongroup.co.uk - you need to register for an account at the forum there (free), then have a look around the forums and template library0

Hi. I received a letter form Halifax plc this morning letting me know that they were unable to pay a cheque Id posted for £13.50. Halifax are charing me £39. Can I claim this back or is it my fault?
Also I know Ive had charged applied to my account in the past due to not having enough money in my account for direct debits etc. Ive logged onto the consumer action group web site but unsure of which letter I send out first. Is it the list of charges one and how do i pay the £10? Do I put a cheque in with the letter and who do I make it out to?
Thanks.0 -
Have a poke around on the Halifax forum over at CAG - it's probably the most popular one on there
You need to send a Subject Access Request under the Data Protection Act. Cheque for £10 payable to Halifax plc. The address to send it to is on that forum too, I think, failing that send it to Head Office0 -
This has been the first time I've heard about claiming back bank charges and am finding it hard to believe, so would just like some clarification on the matter. I have an Alliance and Leicester premier current account, and have just gone through 2 years worth of bank statements and found out I have paid £500 in bank charges. Most of them have been my fault, overspending etc. But there are a few on there where they've charged me £30 for failed cheques. There are also a couple where I've gone overdrawn without even realising ,and have charged me £25 on day one of being overdrawn, £25 day three, etc.Does it also count if they've honoured cheques when i haven't had the funds in my account, and the amount they've honoured exceeds the charge fee.is it still my right to claim all of these back when it's been my fault. This question probably has been asked a thousand times, but am finding difficult to be true.
Also, can someone tell me how I go about writing to A and L. Do I have to list all of the charges and give reasons, etc. Has anyone had sucess stories with A and L and claiming there charges back. Can anyone tell me how long the process takes.0 -
