  • You do it again. BY LETTER. A fax, with receipt or not, can be deemed insufficient proof of communication, even in this day and age. I would recommend that you go to the PO, and obtain a certificate of posting, you only need proof of sending, not of receiving.

    And I normally wouldn't advocate this, bu thave you tried phonign them to check whether s/one is actually dealing with this, and light a petard under their butt? I had to with Natwest, and once I had established to the supercilious oik who was tring to look down his nose at me that I was about to lodge a complaint with the IC, I had the rest of my info within 2 days.

    Thanks Bookworm.... Have just phoned them - they cannot find any details of my account anywhere!!! Considering they're meant to keep the details for three years (therefore taking me up to October this year) I'm really shocked. Any ideas as to what I should do??

    Edited because I was still on the phone when I posted the original message.

    Spoke to a lovely lady (yes I got her name). I made a point (politely) of not being happy that they couldn't find any of my account details, so she kept looking (I get the feeling they would have left it if I had). She checked the archives and found some information regarding my account, so believes she should be able to get the statements, and have them sent to my local branch. She is going to see what she can find, and why the account was 'lost'. I've got her full name and direct number for the department (in case I need to 'hurry her up' - her words). Hopefully she will give me a call by tomorrow afternoon, if not I will call her.

    By the way - Bookworm... did you get that letter?? I had an email returned but I didn't recognise the email address. PM me if you haven't had it.
  • Just had a call from Cathy - can't believe how quick she was, I didn't even tell her that I would report her to the IC if I didn't get the information. Just asked for her help.

    She's managed to request all of the statements, and they will be at my local branch for collection within a week. She's given me their number to call to check, and said that if there are any gaps, or I haven't got all the information I need just to give her a call!

    I believe I need to go into the branch as I have to take ID, due to my address being completely different from when I opened and shut my account.

    I'll keep you all updated.

    my claim to lloyds was issued on on 01/06/06 and acknowledged on the 08/06/06 form what date do they 28days to settle?

    Seems like I'm not the only one but A&L have hit me with their ridiculous penalty charges for going overdrawn. I was a couple of days late with the monthly funding and the £250 to the regular saving caused me to go overdrawn by less than £5. This obviously meant a £25 charge which I got refunded as they admitted it was unfair. However, a week later I checked the account and there were two further £25 charges which they have just told me are legitimate. How can this be !!!

    I do appreciate that this was caused by my own error, but what course of action should I pursue now?

    A £50 penalty for a few pounds for a few days seems mad. I will be writing a letter highlighting my displeasure with them and asking for a refund. What should I include in this to strengthen my case?
  • Well I've done it! claim now with the court (had to wait to get £120 together!)

    Here's hoping to by over £3k less in debt within a couple of weeks!

    I am looking through my charges and they have the following:

    £30 to pay an item when the account is overdrawn
    and then charges..
    an additional £28 unauthourised overdraft fee

    Can I claim both of these back or just the £30?
  • Sorry if this has been covered earlier on in the thread. On the 14th June A&L issued me with a paid transaction charge of £25 as there were insufficient funds in my account. I have a £250 overdraft limit and the payment was for £30 in a cheque. I was just wondering if I am able to claim that payment back? I got paid on the 15th June as well. In the letter that was sent out from A&L it says 'a paid transaction charge of £25 has been raised for each of these transactions in line with out published tariff'. Does this mean that I cannot claim back?

    Any advice is greatfully received

    Well - first of all, a success to report.

    I claimed back £700 of charges from Smile - the Co-op bank, they sent a letter saying they'd investigate, and I checked my account today (about 10 days from prelim letter), to find they'd put the £700 in my account - pretty much silently.

    Second - a question.

    I presume they'll continue to make these charges when I screw up (I've got horribly complicated finances, terrible cashflow, and generally I'm an idiot). Do people have any plan of action against this going forward?

    Hi!

    I've started trying to regain my bank charges, but am a bit confused as what to do next. I used the template asking for my last 6 years of statements, which they sent me. I've been through and worked out how many times etc I've been charged. But then I go for the template to ask for this money back and it also mentions interest. I've put my charges in the spreadsheet, but it says not to send this off otherwise it looks like I don't know what I'm doing... lol which I don't!

    So do I just send them a letter now saying 'you've charged me £400 illegally, I want it back' (or along those lines, lol) or do I ask for interest at 8% too? And do I need to send a list of all the dates where they charged me, or do I just send the letter and let them work it all out?

  • I am currently sorting out paper work with the student loans company for a deferment. I have been given a 28 day deferment, which means they don't don't take the payment from my direct debit but i still owe them the money. So now I am one moths payment in arrears (trust me, no logic, left hand right hand stuff). So, still within my 28 days of deferment my second payment will fall due- and they will write to me this time and charge me £20. I will get a backk dated deferment as i am not working (at home with kids and no income). Can i claim any charges back?
