In the long run, history shows that it's still the greedy bstrds who come out on top, so I wdn't lose too much sleep over that, frankly. Or I could even take a leaf from the greedy bstrds' book, and say: "I don't care!!!" :D

    If you are on certain benefits, you do not have to pay Court fees, but you can't put your claim online either, you will have to go and file in your local courts with proof of your exemption. The form is called an N1 and can be downloaded. There is a link for that and another link to a list of who's exempt or not in the CAG Library, click on my sig and register free for access.

    ......They were then, they are now. Penalty case law is a ruling from 1915 (Dunlop Pneumatic Tyre Co. Ltd. v New Garage & Motor Co. Ltd. , if you're interested), when Lord Dunedin made a very clear definition of what constitutes a penalty charge. The whole concept of unlawful bank charges stems from this and subsequent rulings.
    I appreciate the info. As to your other comment, I see the problem as being that some will not read elsewhere because they are intent on their thing and won't see that they have to carry some responsibilty themdelves. I think the abuse meted out by some prvoes the point.

    Perhaps if we all took more care then those greedy bstrds would not prosper and we wouldnt be having this conversation now.

    Absolutely! How about the banks who have a duty of care and trust start first?
    1) by functioning within the laws of this country,
    2) by not making the mistakes themselves? I recently reclaimed £170 from Halifax. The cause of the initial charge which then snowballed to the above amount? Their own insurance, which took a higher payment than agreed! Oh, they refunded the difference, but wouldn't refund the charges levied from their own incompetence!

    I promise you, the day the banks start working lawfully, the whole concept of penalty charges reclaim will collapse. And I for one, will stand up and applaud loudly.

    well I interpret unlawful as breaking the law, if they not breaking the law why arent they defending themselves in court?
