I have a thick question. I am now at the stage when I send the letter two weeks before taking them to court. On the Bank Action Forum there is a bit in red that you include if you have had a default notice made against you. How do I know if I have had a default notice made against me?
I wanted to send the letter as it was due to be sent today (two weeks from the first but i'm not sure about default notices)

You'll have to do a credit check.
  • Just wanted to say, I started my claim against my bank Smile after much help from the peeps of the forum (Thanks!) And a couple weeks back I received a letter saying they'd get back to me. Today I look in my bank and I'm now 1000 pounds richer! Which has also got me out of debt! THANK GOD FOR MARTINS MONEY SAVING TIPS!

    Hi,

I'm trying to work out how much the bank would owe me if i make a claim.

Going throw my bank statements which i asked them for, i've found that i've been charged £1220 over the last six years.

I want to send the Letter - Preliminary approach for repayment.
I see that with it i need to send my scedule of charges but i can not work at how to use the Spread sheet on the Consumer Action Groups web site.
On top of that my printer has now broke  so i'll be writing it all out by hand.

Do i really need to this Spread sheet? is there a way around it?

    Thanks

Hi All, I'm new here and really loving the advice! Have saved heaps from my internet provider and sky dd bill already.
Anyway, in relation to the claiming back of Bank charges i am going for it! My Bank is Abbey and it would seem they are likely to close my account. If or rather when it gets to that point i will get back to you as to where to take it next.
What it is i'm wondering is this, when i originally opened my account it was with a branch in Cardiff, i then moved back to Edinburgh and changed my Branch to one here. Will i get the info i request from both cardiff and Edinburgh (been back home 5.5 years) ?
Also, my partner split with his wife around 4 years ago and closed down their joint account as wifey was taking his wages and pretending to pay the bills. Now, if he decides to claim back his charges from when he was Married will she automatically receive half? He has two accounts that we will enjoy claiming the money back from. Getting married next month so the money would be very useful!!
Thanks in advance for any help!
    Kirstie.

You don't need the spreadsheet at this stage, it will become necessary if you have to issue a court claim.

But you need to write a list of the charges, when incurred, how much for etc... We only advise you to do the s/s because if you have to issue claim then you'll be doing twice.

There is also on online calculator on CAG HERE.

Your info can be obtained from anywhere, it will probably be sent off elsewhere to retrieve anyway.

That's one for the divorce lawyers, that one. It will depend on what agreement was made, who paid what to whom. All I can say is that your partner can claim, and the money will go to him. Whether he has to then split it with ex, as I said, that's not something I can answer.

thank you for your reply. My partners divorce was finalised a few months ago and a condition of the divorce (stipulated by us!) was no payment was to be made to her before or after the divorce so thats something i suppose!
I am feeling quite nervous about having my account closed when i have claimed my money back (successfully i hope) and the transferring of all my debits etc !
Anyone had any joy with Abbey AND kept their account?
  • well thanks to all on here - I approached Natwest with letter asking for charges back, they refused so paid for a small claims court claim and filed it against them for £400. Their legal department wrote back and said wasnt economically viable for them to contest it and enclosed a cheque for £400. Result!!!! They said it was on condition I withdrew court claim or went to the press.

My husband and I had an account with barclays with an overdraft that frequently incurred charges however in september last year we bit the bullet and accepted we couldn't affordthe debt we had. I now have a DMP with CCCS which includes the barclays overdraft. Can I still make a claim? Esentially I still owe them money although I'm slowly paying them off. This is also the case with barclaycard - I recall having to pay them charges on occasion but they are also part of the DMP
    Titch :)
  • I don't see why not. It may well be that any charges reclaimed will have to go in the "pot" as it were. but hey, it all helps....

I'm not 100% up with the DMPs, but if you click on my sig and register there, I am sure there'll be s/one there who is.
