  • I am with the nationwide building society..and l contacted them about a rebate for the charges l have had over the past few years, and basically, they said "tough- l was warned about the charges and l have to pay them." mine must add up to thousands! any advice? thanks.

    Is it possible to claim back charges for exceeding your overdraft limit? I have been paying so much lately and was stuck in a vicious circle of being charged, not having enough money to cover the charge thus going overdrawn again and being charged for that. It seems unlikely they would pay me any of this back though as i should'nt have gone over the overdraft in the first place??

    I would like to make a point aboutthose who think, that because of recent rulings about charges, they have the banks over a barrel.

    1. They may offer free personal banking. That is a commercial decision and I would suggest that there is nothing to withdraw the facility individually or globally.

    2. There is nothing to prevent the lending criteria from being made stricter- less tolerance of excess o/ds. lower or withdrawn limits, more bounced cheques and unpaid s/os d/ds.

    3. You do not have to bank with a particular bank and nor does a bank have to have your account Thy can close accounts and pursue for debts.

    I think there exists a perception that because of competition and the governments desire to get a banked society #3 will never happen. I would not be so sure. I'll draw an analogy.

    Within its limitations a LA will try to find accomodation for the homeless. However there was a cocept of making ones-self intentionally homeless. Were that concept applied then some might find themselves bankless. In a society where I am aware that some petrol stations have chosen not to accept certain payment methods. well! Cash is inconvenient to carry round and costly to handle. Surcharges for cash or discounts for approved trnasaction media. who knows it could not happen?

    point #2 is a weird one.

    my bank lloyds tsb stopped clearing stuff that would take me overdrawn a couple of years ago and now will NEVER clear anything that exceeds my limit even if by 1 penny and even if I ask.

    My sister in hsbc often gets payments cleared over her limit and can still use her card although hsbc do charge her but at least her payments get cleared.

    HI Chrysalis, I'm not too sure why #2 is called weird; perhaps you mean the person who made it;) . I was of course writing of the gerneral policy (aka herd reaction) of the industry. As to your and your sister's expereiences IMHO a mix od policy and perception comes in to play, with matters like the time of the month-not the cycle:eek: - but time before expected salary, and I'm sure that some have had a pleasant/nasty shock when a relief manager takes over control.

    I have the bit from CAG which starts "I have a contract with the defendant bank dated XXXX and which is conducted on their standard terms and onditions"

    How do I find out teh dtae of the contract? The date my account was opened?

    Also, I take it the court would like to 'see' the amounts from my spreadsheet - but can see no way of attaching/impoting files into the claim?

    I'm really nervous about this as I have a £2k OD and this claim is now £3.5k and would really like to get it sorted to clear that OD (OD limit is £1k btw...)

    I took out the bit about the contract with the bank as I didn't know the dates either, so just missed it out.

    As for the breakdown of charges, you don't have to worry about that at this stage I don't think. I never got asked for a breakdown - I imagine that is only if you have to prepare a court case. Again, something I didn't bother with and never got asked.

    Hey folks. Interesting stuff. Havent read through this thread (no thank! 42 pages!), but my GF went £11.50 past her over-draft this week and has been charged £30 (and told she will be charged a further £30 for every day it remains that way) by Lloyds TSB.

    Do we have any hope of claiming this back?
